Any approved AC21 cases for EB3 ??

Hello,

Are there any Approved cases for AC21 on EB3 ?? - So far i have only heard for EB2 ...

Wondering if its not a good idea to use AC21 on EB3 cases - as i see there are lots of I485 RFE's or denials ???

LC approved October 06
I-140 approved November 06
EB3
H1-B 7th year, in process of applying 3 yr extension on the basis of I-140.

Question is can I change jobs within the same company and move to a different state.

You see EB2 because EB2 dates are better than EB3. There is no difference in the way USCIS handles EB2 or EB3 at 485 stage.

If you want to use AC21 to change jobs, it is your decision to make. Risk is always there but as long as you follow law, the eventual outcome will be positive. The questions you got to ask yourselves is that
1. Are you willing to take chances and are you prepared to fight to overcome any hurdles?
2. Are you following the law?

If "yes" to both the questions, then you are ok to change.
