Here is my status. I-140 Approved Mid January 2001. Still Waiting for 485 approval. 485 Msg Says RFE recd on 01/16/00. I-140 Msg DOES not say I-140 approved but recd approval notice from atty.

Thanks Tailgate.My 140 redo approved 02/13, message changed too.I spoke to IIO on last Friday and was told to wait 30 to 45 days.I know that\'s a standard answer but I am happy not to hear it\'s on hold or waiting for some sort of directives!.

Govinda Vinod and all other members of this gang please keep us posted with any developments.

My i140 approved on 01/25/01, the message has changed, I485 still pending, called IIO and told me wait for 30 days as usual

even saying it\'s on hold doesn\'t make sense because the Amend. was done based on law regulated on 1993, and has nothing to do with any new laws, but what can you say for those AH IIO.

Does the new law state that I-140 redos are NOT required?

I am confused as to why else VSC would stop processing these
cases.

I don\'t know how will the new laws affect the process, but when i got the RFE to redo the I140, the letter said that based on some regulation in 1993 , pla, pla, . i have to redo the I140. so this not related to the new laws.

Redo was approved on 01/31/01 and the message changed.
I-485 Approved on 02/22/01 and was notified by legal to me today. I checked the message and delighted to hear that This case is approved .....\'

This is (almost) exactly what my employer is also telling me. He says that they are trying to decide, based on the new rule, whether or not to issue I-140 redo RFEs (as if nobody can understand the language of the new rule and how to implement it) and are waiting for a clarification from INS HQ in Washington D.C. The funny part is that INS HQ has all along (even before the new rule) maintained that in the case of a clear-cut successor-in-interest, an I-140 redo is NOT needed, but INS Vermont (ONLY) chose to tow a different line. Now, with all those I-140 redo RFEs and the new rule, it looks like they are confused again. Now it seems that their official policy is to hold processing of cases where an I-140 redo might be required. And to our "benefit", some officers seem to be stopping processing even I-485s where an I-140 (redo) has been approved....

I Agree with Govinda. When I asked IIO when i spoke to him last week, since u have 2 I-140\'s approved then why the hold , then he told that in general they decided to keep a hold on all cases with name changes, mergers etc. But seeing the trickle of 485 approvals for our type of cases, it seems that most officers are setting aside the name change applications. Also I have not seen any RFE\'s posted asking for I-140 redo. We used to see these RFE\'s in tons during december and earlier on. Anyway no other go but to hold our breath and wait for the ride to end.

How to redo I140 ? Here is my situation, I have a 140 approved
last Oct. But my division is spun off from the old company. I have
a new I140 application pending in VSC. Now my PD become current,
can I file I485 with the approved I140(under old company name) ?
Is there anyway to let VSC expedite on my new I140 application ?
any advice appreciated !
