Anticipating Marriage - Have already postponed C.P. Twice

Hi Folks,

I need to make a tough decision regarding my upcoming CP Interview at Delhi and I need your advice.

Background Context -

My first interview invite came for Dec 2003 and I got it postponed to Jan 2004 and then again got it postponed to a later date (which I couldn't pick). I was just notified yesterday that the new date is 3rd March (next week). All along, I have been buying time to get married before I take my interview.

I have been continuously employed by the same firm who filed my petition and my job is safe.

Questions -

Given the above context, I would really appreciate if you could answer my following questions -

a. Would it be ok to get my interview date (3rd March) postponed one more time (i.e. the third time)?

b. If yes, do you think it is possible to request for a new interview date as late as September 2004? My wedding date is getting finalized for that month.

c. In general, is there any maximum allowable time in which I have to take the interview?

I understand that this may be a unique case and I really need your advice before I make a decision.

Answer: Entirely upto you to reschedule! I recommending attending the interview and getting married before the interview and providing the marriage cert during your interview along with ds 230 form for your wife so that you complete your interview as scheduled and your wife gets called for her interview in about 60 days from your interview date! But again rescheduling is your decision to make!

Answer: Your interview should ideally happen within 365 days of your initial scheduled interview! Your wedding date is in what month>? March or September! Bottom line is getting married prior to your cp interview!

Your comments are very helpful. But let me re-phrase my questions so I can make a decision with conviction -

1. When I call the Delhi US Embassy, do you think they will give me the flexibility to pick September or beyond as the month for my interview? Aren't dates picked randomly by their computer?

2. If I can get it postponed to September, do you know if the fact that this would be the third postponement and the delay would have been 9 months from the original issued date, would be viewed in bad light by the consulate?

3. You mentioned that "Your interview should ideally happen within 365 days of your initial scheduled interview":-
This is very encouraging information. Is this a RULE that you know for sure holds true?

Answer: Interview dates are assigned by officers @ the consulate once all required admin processing @ consulate is done and once it is your turn for the interview. There is no harm asking for a specific month if you have a valid reason which I personally think you have. Obviously your spouse will not get same interview date as yours. So if you get scheduled in september after your marriage carry your marriage cert along with ds 230 form filled out by your wife so that she could get an interview within 60 days of your interview.

Answer: Since your reason is valid i think it should be fine. But again emphasis is this is my thinking...not sure how the consulate would think!

Answer: I remember this based on a couple of posting from the past where someone rescheduled for valid reasons and he had received a reply from the consulate that the interview would be scheduled within 365 days of originally scheduled interview.

Bottom line, there is no harm requesting a postponement of the interview by stating marriage in near future as a reason! And you can try requesting a specific month of your choice and see what happens!
 
Concerns on adding spouse just before interview

Dear kd1403:

This is in continuation to our correspondence in Feb 2004.

I plan to get married 10 days before my interview next month in Delhi. From your earlier response on this thread, it seems that even if I manage to procure my Marriage Certificate and all the required documents for my spouse, and then add my spouse's name to my file before my interview, she will not be able to appear with me for the interview. As per your response, it seems that they will give her a separate interview date within 60 days.

This comes as a surprise to me, since a friend of mine who had the same case as mine in Jan 2002, was able to appear for the interview alongwith his wife and immigrate to the US with her. In his case, he got married, got his Marriage Certificate and his wife's documents in order, and appeared for interview - all in 10 days!

Has any process changed since Jan 2002, that implies that my wife will have to wait for her interview call?

My wife and I would be very disappointed if following our wedding, the interview procedure prevents my wife from joining me in the US right after the interview. Thus, your response is quite comforting.

However, I wonder if the consulate in Pakistan follows the same C.P. procedures as the consulate in Delhi. Also, what month and year did your friend get his Interview process completed?

Yes, getting my fiance's documents ready is my focus for now.

Her passport, PCC, Birth Cert and other documents are ready. However, per my understanding since I am not married yet, I cannot get her medical exam done (the hospital will ask my wife to produce the interview invite on her name first). Please let me know if you have any further suggestions.

No the process has not changed since Jan 2002 especially related to the situation that we are discussing.

Let me repeat this clearly. In your case if you want your to-be-wife to attend the interview along with you, then you will need to do the following AS SOON AS POSSIBLE: submit her ds 230 part 1 to the consulate along with a letter that you plan to get married prior to cp interview and that you would produce marriage related evidence at the time of the interview. Include your CP case number on her application. You need to do this well in advance of the marriage providing the consulate sufficient time to run administrative work and name/ fbi check. Also you should be able to request late September - early October since you are getting married then. One cannot walk into the consulate with a newly married wife who has not submitted a ds 230 part 1 to the consulate prior to the interview. Remember that since your marriage will be less than 2 years old, your spouse will get CONDITIONAL GC where the condition can be removed after 2 years of marriage.

Thanks for your response. Just for the record, my marriage has now been fixed for June 23rd and my CP Interview is scheduled for July 1st, both in Delhi.

I have a couple of more questions for you -

1. It is clear that submitting my would-be-wife's DS 230 Part I ahead of my marriage would be seen as a slightly unique case by the officers. Would they accept my request to add her form like this? Do you know of anyone who has done this sort of thing before?

2. For my fiance, regarding fields like FAMILY NAME, MARITAL STATUS in the DS 230 form - should I enter her particulars right now as if we were already married?

Once again I do understand that I need to clearly state my intent in the covering letter but I just want to make sure that providing this information pro-actively isn't interpretted as a shortcut or even fraudulent.

Answer: I have seen a number of postings where this has been done. So although unique for us, the consular officer are expected to be aware of it. Remember to have your to-be wife file for 2 PCC's and all other documents that a spouse would need to carry. Research on this forum for CP and fiance.

Answer: Currently Write her current correct maiden name and contact information prior to marriage and when you both attend the interview after marriage carry an updated DS 230 part i and ii with same details except with married name information for your spouse and submit along with marrriage cert, marriage invitation and marriage photos as a proof of marriage.
 
Rescheduling CP Interview

I may need to reschedule my CP interview due to
this project I am working on..

How exactly one can request the Counslar for
Rescheduling CP interview & Do they let you pick up the dates?
Is it possible to extend 2 or 3 months....?

You can send them an email or call them with your request. Normally it is hard to predict what date they are or going to give you. You can ask them for your month specifically though.

I agree with leverzerocool and to add to his posting you need to provide a valid reason for reschedule. Remember work commitments are not being considered as valid reason for rescheduling.

But a part of your posting confuses me. Ar eyou saying that you are waiting for your I-140 approval or your I-140 has been approved and your CP interview scheduled?

IT takes about 6-8 months after I-140 approval for a person to get an interview at an indian consulate. REmember one thing do not try to fudge reasons to reschedule cp interview as it may (not will) backfire and it is not worth it. Since you have at least 6-8 months still, you relatively have a long way to go before you start thinking of rescheduling cp interview. So wait until your P3 is reviewed and mailed to your consulate and at that point think of resheduling IF THERE IS A TRUE NEED such as family reasons, spouse pregnan, medical reasons and so on.
