Another RE permit question

My spouse applied for REP, did Biometrics, etc and then we were out of country due to his sick parent. We were gone for about 2 months...We came back to the US for 2 weeks and had some routine testing for our daughter done (who also has a medical issue) and she has some things going on as well, that were unexpected, so we are both in the US due to her.... In other words, we are not using this REP at this point b/c we are here.

I guess it is good for 2 years. His parent got slightly better in the time we were there as he was elated we were back maybe his spirits lifted as well. Who knows, but he is still very sick but of course no timeline with his illness (Terminal). So it could very well be that he (spouse) just travels back and forth frequently to visit his sick dad with always the unknown how long he will stay (unless our child checks out fine soon-then we would all go back to spend time with his dad)....

My question is~ if spouse had to apply for another at the expiration of this REP, would they look at our time actually spent IN the US even though we had the REP the first time? Would it be easy to get it again if he needed it because it shows he was not out too much? We only applied for it b/c we thought his dad was not going to make it recently-he will never recover but probably go on to live as best in the short term as best he can at this point ..I just wonder if later what our options would be...since things don't always go as you 'plan' for them..

Thanks..v

A re-entry permit is good for two years for the first and second permit. A third permit is issued for only one year. [However, a Conditional Resident might not have full validity permit during the conditional period. I don't know if that applies here.]

After that, they start looking at documenting an abandonment of LPR status. Everyone's situation is different and on a case-by-case basis.

Goos Luck,
