Another eligibility question

Hello All,

I have one small question on the eligibility for US Citizenship.If someone maintains continuous residency for all four years and nine months and then goes abroad for three months and comes back , will he/she be able to apply for Citizenship without any issues.?

Meaning , Can someone stay abroad for 3-4 months just before becoming eligible for citizenship. Assuming residency is maintained in US, and trip is of short and temporary nature...

Yes, you are eligible. You could have a problem in the case you stay outside of the US for more than 6 month.
 
If you go 3-4 months in the middle of the 5 years - > yeah sure
If you go 3-4 months just before you apply -> you may be testing the limits of the requirement for a 3 month residenency requirement (applying in the district where you live).

Make sure you maintain residency in the state you live in if you have to go before applying.

best approach - > Send your application and then take off (and return within 6 months!!)

Sending application and taking off might not be the best approach because of fingerprints - usually one gets FP appointment a month or two after filing...

I found this web site this morning and I will keep the board posted about my N-400. (Connecticut state)

Just a question - I had gone to India just before applying for my N-400, but I kept my apt and I was paying all bills (utilities/phone) electronically via my bank account, during that period. I have stayed in the same place for more than 5 years. What proof is required to show my residency? Just bank statements will do? I am self employed, so I can't have employer letter. All payments are electronic, so no paper trail.

I am assuming one can travel, (even 5+ months, but less than 6 months) just before applying N-400, as long as residence is maintained, as p8085 mentioned.

you can travel under 6 months and not break any requirements. As long as you had an apartment, had a bank statement etc you are in good stead and should not have a problem.

If somone winds up their primary residence and moves abroad while waiting for their CZ (as some people have posted in prev threads) that may cause problems.

for the 3 months residency in the state, i assume that since somebody pay taxes and have ID of a state thats mean that he is resident in that state.
if u travel or not you stil reside in that state

I think i did the requirement for 3months residency if u lived in one state for example and then u want to apply in another state, so you have to live in the new state for 3 months.

otherwise they will have to define continouse residency and permanent presence in the state and we will never be done following those rules.

I believe that the rules about travel apply only for physical presence and continuouse residency in the US , but dont apply for the state.

What do you think rahul and you guys about that??

Correct. But if you vacate your home and move aborad while waiting for CZ it may not be a good idea. Also some examiners may interpret the law very narrowly by meaning that you should have been physically present the 3 months prior to applying in that state (even though this is not the actual case). Just a precaution

Correct, but there is a state residency requirement. In general its better not to apply for docs from overseas or have a long absence just before applying as it may interfere with residency requirement. Low probability but its good to be aware of this
 
Hello All,

One more question. If someone completes 5 continuous years after GC , and , becomes eligible for CZP in April , I know that they can apply in January itself (90 days before). However will they (probably) receive fingerprints in one or two months , from the date of application or from the date of completion of 5 years....


Meaning , Can the fingerprints be asked before April or will it be only after April. [April being 5 full yr completion month].
