Another divorce question...

Hi, hoping someone can help. I searched the forums and found a lot of threads about divorce of a citizen and non-citizen, but none specific to my situation (two non-citizens).

I am Canadian. My husband is Canadian. We moved to the US in 2005 for his job (TN/TD, to H1B/H4), and got our "green cards" a few years later (good for 10 years). If we were to divorce, could we both stay in the US for the remainder of our 10 years? Would we both be able to apply for renewal when they are set to expire? Thanks.

See below answers in bold. Hopefully you guys are able to work it out after being together this long.

If we were to divorce, could we both stay in the US for the remainder of our 10 years? YES Would we both be able to apply for renewal when they are set to expire? YES Thanks.

Thanks anaga73. That is actually quite sweet of you to say. We've been together a very long time, and I'm hoping we can work through it. Thank you for the info.

its says on the approval that status would be invalidate after expiry or not.

Usually if you hage 10 years GC, your status never expire even after card expired.

Which means you will not be out of status even the card expired or you don't have to leave the country if you card expired.

Sounds like in your case (both of you) that your green card status will never expire, even after the card expired.
