Another AC21 Case approval

All:

Thanks for all the help this forum gave me to get my GC.
Finally i got GC stamped .
Historey of My GC :

My labour is filed in CA with company A -2000
Applied I 140 and left to Company B
Transferred my H1B to Company B - 2001
Company A continues my GC proocess
My I 140 Approved with Company A - 2001
Company A official missed my I 140 Original During 2001-2003
Finally May 2003 Company A applied I 485 Intention to re employ me ( I got I 140 Document after from the person who missed after 18 mo)
INS issues RFE for Future Employment letter
Company A declines due to new management
used AC21 with Company B .
Got approval and Stamped ..


I have used Sample AC21 letter provided by Ginnu here in this forum to answer my RFE . Without this forum i can not got thru RFE .

FYI :
I have mentioned my I 485 Status when my Company B recently applied my H1 B renewal . So INS does noy have any issue with my AC 21 application as i asked INS to approve my case with my current employer ..

I485 - PD April 2001/RD May 2003 .
Approval : July 2004.

Mine is also similar case, I know exactly how it feels
when you get approval on such a case,
anyways, enjoy the freedom from cluthes of H1 !!!!

Guys,

I have the similar case as MAMU1971. Here it is..

My labour is filed in CA with company A - Jan 2001
Applied I 140 and left to Company B
Transferred my H1B to Company B - May 2001
Company A continues my GC proocess
My I 140 Approved with Company A - July 2001
Finally July 2002 Company A applied I 485 Intention to re employ me (Also attached the current Company B Employment Verification Letter and w-2 with I-485)
Left the Company B and Joined with Company C in March 2003
Transferred my H1B to Company C - March 2003
Got approval in July 2004 and Stamped in Aug 2004.
No RFE from INS.

I have couple of questions.
1. Do i need to file AC21 now?. Or i have to work for the Company A?
2. At stamping i gave all the EAD's, AP's, I-94 (which was attached to Passport) but not I-94 in the latest H-1B approval. Is that going to give me a problem??

Please help.

I'm not an expert in these matters, so I can't say anything,
mine is also similar case like yours - I posted my case details in this forum,

but I have a question for you,
you mentioned, that, company "A" filed your I-485
while you were working for company "B",

for some reason, I thought, you have to mention
current working company in your I-485 application,
that's what my attorney told me - correct me if I'm wrong,

also, did you go thru an attorney or you filed your I-485 application
yourself ??

Infact Company "A", told me that, they file my I-485 thru Lawyer, but they did file by themself. When i came to know, they said, they verified all the paperwork with Attorney and filed. I even insisted to file thru Attorney, but they never did.

But Labor and I-140 got filed thru Attorney.

lot of loop holes in AC21.

and we, who used AC21, are in a kind of total caous

Even though GC approved and PP stamped. But still i'm in Dilama what to do after that based on the conditions mensioned above

I'm happy that INS didn't issue any RFE on my case, but on the other hand i'm not happy that i didn't inform about my job change. I was even under impression that my case don't come under AC-21 Law. that's the reason, i didn't file AC-21 paperwork.

Question is Am'I Done the right thing??
 
Its my personal opinion - may be its correct and may be its not,
we should be ok until time of citizenship ,
only problem, I foresee is at the time time of citizenship

I checked with my attorney, they said, at this point
there no regulations as to how USCIS will treat all these
AC21 cases,
also, its just being 3 years now after AC21 came into effect,
so, no one really knows what will happen to these cases
at the time of citizenship
 
As a matter of fact, i did check with Immigration Attorney, his recomendations are..

1. Sent the Letter of Intension of Joining to that company by Certified Mail with returned Receipt.
2. Ask them to put your name in Payroll and work for them atleast 15 days or more and get pay stub.
3. Later you can resign them showing some cause.

Can some one has any sample format of Letter of Intension of Joining??
