are you serious? that is the most ridiculous thing i've heard. I raised so much hell because my I-485 process took 15 mos that I contacted 4 senators of which two of them ( their staff) contacted me back in writing saying they'll put a call through to INS regarding the delay on my case. within 2 weeks of that, I go approved.

Unless you have something to hide or unless your case is fishy, the more attention you draw to it, the faster you will get expedited. One word of advice.....it'll be very difficult to get ahead in this country by being a shrinking violet.

Would you care to elaborate on the steps you took. Was your case beyond the deadlines published. How were you able to contact 4 senators given that you are from one state. Please post the details so that other folks including me can learn from it

Thanks in advance

hello tru

My case was in the nebraska service center and i'm from michigan. after waiting more than the stated 480 days on my I-485 receipt notice, i contacted my two michigan senators as well as senator john mccain and senator john edwards. I contacted the two outside senators because i heard they were pro legal immigration. the following is the letter i sent. I got positive feedback from both michigan senators' offices saying that they'll check up on my case and within two weeks of that promise, i got approved. I prepared the format myself and i'm not saying this is the right way or the only way. Although if i hadn't gotten a response, i would have written another letter detailing who this delay is adversely affecting my life (i.e. can't go to home country on long vacation, can't buy house, constant stress).

Your Honor,

I have lived in the state of Michigan for the past 5 years and I have been processing my green card application through my employer during this time. The process seems to have slowed to a trickle and nobody in the new INS can provide any information on why my case is being delayed. After almost 3 years of waiting, I am at the end of my patience.

I was hoping if your office could ask on behalf of me and get a better rersponse. My case number is LIN-02. I have been in this country legally and I have filed all the proper documentation. I just need to know why the application is taking so long when other applications in different service centers are being approved.

Sincerely,

tombaan

rd: 9/28/01 (nebraska)
nd/10/28/01
rfe: 1/15/03
rfe received by INS: 3/7/03
started contacting senators/congressman/governor(i'm not kidding!!): mid april
adjudicated: 5/16/03

what's weird is i had spoken to an IIO only a week before i was approved and she said my case hasn't even gone to an officer and didn't know why and couldn't tell me when it would go.

tombann,

no, i never got interviewed. the rfe was for birth certificate and employment letter. I was laid off after 180 days from my petitioning employer and found another similar job. as per my lawyer's suggestion, i hadn't notified INS. For some reason, INS wanted to see if my employment was still "valid". so i invoked ac-21, gave new offer letter (without paystubs). 2 1/2 mos later i got approved.

tombaan,

that's a mystery, i don't know how they knew. I know my old employer couldn't care less and it was an cordial departure, but what may have happened is they may have cancelled my h1 since i got my EAD. Or maybe it was just a routine query. Nebraska sems to be issuing more rfes these days than adjudication notices.

goastros,

i was lucky in the sense that i got the second job within two weeks of my layoff (april 02). and since i got severace pay from my old job, in practice i was never without a paycheck. I know if i lose my job now, it'll take at least two months to find a new one!

One thing I have heard from my attorney is that
even though NSC is faster than TSC , they scrutinize more.
That sounds consistent with what dawg is saying abt "Nebraska sems to be issuing more rfes ".
