I would like an attorney to help me and my soon to be wife file her papers and maybe offer some advice for interviews. She intially came here on a J1 visa (not with 2 year bar) and then applied for adjusmtent to visitor's visa which was pendent till april 2009 ( she tried to change in october ) first is this case complicated and what would a avergae cost for a lawyer to assit me.

Well, I know someone who had an attorney while marrying the girls from abroad and he paid couple thousand dollars. Now since you have a different case it may be different.
 
Your case is not complicated.
It now depends on how long you have known each other and if you can prove it.
Once she is married and applies for AOS, her overstay will be forgiven.

You don't need an attorney.
However if you would like one it would cost between $2000 and $3000.
 
Hiring an attorney for the Adjustment of Status stage would cost around $2,000. You can prepare and file all paperwork yourself though. I did that myself, but I also consulted with an immigration attorney through the legal plan at bestimmigrationlawyers.com. The cost was $16 flat monthly fee for their unlimited phone consultations. The attorney, who I consulted, Edwin Lee, offered for me to hire him officially but I declined since I found the consultations to be sufficient and I did not want to pay $2,000 just for him to sign on the application. So far everything is OK with my AOS application and I got the work permits and advance parole documents without any problems. I'm in Texas so you have to check on the website if these immigration consultations are offered in your state. Good luck.
PS: I think one is allowed up to 180 days out of status in the US so your wife-to-be should be OK filing the AOS application.

I think if the status change to Visitor is approved by USCIS , it is straight forward. If not I would recommend that you hire an Attorney .

The Key to all this is to have I-94 Form on the Approved Visitor Status Change from USCIS which has not expired to file for AOS which would eliminate the need for an Attorney.
