An asylum-based I485 & a spouse-based I485, which is faster?

She cannot file a spousal I-485 yet. First, you need to file an I-130 for her. The date of filing for the I-130 will become her priority date. Then you will have to watch the State Department's month Visa Bulletin like hawks. See http://travel.state.gov/visa/frvi/b...letin_2631.html. Your category will be family based, 2A. If (and only if) her priorty date becomes current can she file an I-485. As of today, people with priority date earlier than November 1, 2001 can file an I-485. The exception is for people born in Mexico (only PD before October 1, 1998).

I know that this is not going to be the news you want. Sorry.

The law could be changed in the coming months to address this problem. But the chances for that are too uncertain.

So spouse-based I485 needs to take at least 4 years to process??
