American (stuck with name check) marrying a Canadian citizen

Hi

A friend of mine has been in name-checking process for 6+ years. He does not have green card, but otherwise he has legal status, and is on job. Any hope of getting out of this soon, is pretty dim.

He wants to marry a Canadian citizen who is nowadays in US on 5 years multiple visa. Is there a way, she can stay with him here in the US for long? Can she apply for US citizenship? Change her status? Nobody wants to get out of legal status here.

Off course, if it doesn't work out, he is open to moving to Canada, with her.

Please advise.

A Canadian citizen in the US on a 5 year multiple visa? You sure? What kind of a 5 year multiple visa? Surely not B-2? Canadian citizens are only issued K or E visa stickers. For the rest status is given at the POE without a need for a visa.

Every stage in the GC is complete (state, labor), but name-checking is stuck. He applied for GC based on employment a long time ago. Now, he gets work authorization every year.

Hmm...now I am not sure...but she is Candandian citizen and is here on visit. Off course, she can't stay permanently in the US, right?
 
Canadians normally do not require any visa to visit US except for a few special cases. Otherwise, max stay allowed is 180 days. If she overstays then she is doing so illegally. All others means of getting a GC for Canadians are the same for people from anywhere else in the world. Canadians can however apply for TN (NAFTA) work permits to US (available only to Canadians and Mexicans) for eligible professions. These were valid for a year and renewable on a yearly basis however, recently been changed to a 3 year validity. So, a Canadian citizen with a 5 year visa to US sounds highly unusual.
