American living in Italy with Italian Husband K-3?

Hi Just registered here. I have been searching for information all day. I am an American married to an Italian and have been living in Italy since 2009. I want to go home and I want to bring my husband with me. I own a home in America. Everything I'm reading is for someone who is already in America and wants to bring their spouse there. Do I have to go there first? DO I have to work for three years to get the tax papers to be his sponsor? Do we have to be separated for 3 years? Is there another way? Please help!!

Yours is a common situation. File I-130 to initiate the process (forget about K3 which is more expensive overall and doesn't save time anymore). The I-130 should be approved in 3-6 months, after which they'll forward it the consulate in Italy and both you and he will have some more paperwork and fees (and he will have an interview) in the next few months after that.

Since you're not working in America, you can either get a joint sponsor or use your assets to meet the financial requirements.

If the US consulate in Italy allows DCF (Direct Consular Filing), he may be able to get a green card as quickly as 3 months, instead of the usual 6-12 months. For DCF you'd file the I-130 with a consulate, instead of the usual procedure of filing it with a USCIS office in the US and waiting for it to get forwarded to the consulate months later.
