Guys,

I was just talking to my employer and he said that one of the guys in my company got his 140 approved and hold your breath.... His ND is was in March 2nd week 2004 and lo and behold he got his approval in the last week of March. I think he should definitely buy a lottery ticket !!! My ND is 09/2003 and am still waiting as many others..

Just wanted to share this info with the forum. Incidentally he too is an EB2 and also no RFE's generated.

Fast Approval

Hi Friends,
One of my friend did not receive receipt notices for concurrent filing for a month and one fine day, his attorney received them all including 140 approval notice and this was I think in August / September last year (he filed almost 6 months) after mine.

At some forum, I read that after initial adjudication of 140 and if no hold is put on 140 then EAD is approved. This initial adjudication sometimes takes longer than the normal time, which will lead to the approval of 140.

I heard of such cases well in plenty.

Boss said Company not to give EAC Num...

I have a question here. My H1 stamp expires Oct 2004. Six year H1 if extended with all stays abroad included would extend it till May 2005.

Have applied for I140/I485 in Sep 2003 and have got my EAD in Nov 2003. Did not apply for AP and have not yet rcvd my I140 approval.

Question is : Does it make more sense to extend my H1 or go onto EAD and get AP to go abroad considering all expenses are borne by self. Which is safer..

H1 is always safer.You only need use EAD if you want to change the employer. If you are happy with the existing employer then no need to use EAD.But your spouse can use EAD and work which will not have any effect on your H1.

As per AP make sure your Passport is also Stamped with Visa.
If you just have Approved H1 notce and expired Stamp in passport then you need to get it done. If the expiration date of the Visa Stamp is more than 12 months in your PP then you have to go back to home country and get it done.
