Am I out of status?

Hi. Gurus, please advise.

I don\'t know if I am out of status.

My original visa - TD
My current visa - H4

I changed from TD to H4 in the States and have been staying here since. My I94 was still valid at that time when I changed my status. I have new I94 when I received my H4 paper. H4 will expire soon and I already filed I485. My question is am I out of status? I don\'t have any valid passport stamp on my passport since I am not planning to go back to India. I do have AP & EAD but I don\'t use them.

From the details you have provided, no you are not out of status. As long as you have proof of filing for I-485, you are in status. Also from what I\'ve read in this and other forums (including chat transcripts at murthy.com) you can probably travel outside the US and re-enter without problems using your AP.

I think you are not out of status, since you have 485 receipts, also AP. So, even if you travel out of country and come back you can come back on the basis of 485 receipt and AP.
