Am I eligible to apply for the lottery?

Hello,

Im from Mexico and my husband is from Germany. I know that Mexico in an ineligible country and that my husband can include me as a dependent in his application, but I have the following 2 questions.

It says on the requirements that to be eligible to enter the lottery, one must have at least a high school education or some work experience. Does this requirement also apply to me as a dependent in his application?

My second questions comes after reading the eligibility requirements where is says the following:
To enter the DV lottery, you must be a native of one of the listed countries.

Native of a country whose natives qualify: In most cases, this means the country in which you were born. However, there are two other ways you may be able to qualify. First, if you were born in a country whose natives are ineligible but your spouse was born in a country whose natives are eligible, you can claim your spouse’s country of birth—provided that both you and your spouse are on the selected entry, are issued visas, and enter the United States simultaneously. Second, if you were born in a country whose natives are ineligible, but neither of your parents was born there or resided there at the time of your birth, you may claim nativity in one of your parents’ countries of birth if it is a country whose natives qualify for the DV-2012 program.


Does this mean I also qualify to enter the lottery as a primary applicant? I know that 2 people from eligible countries can each submit separate applications to increase their chances according to the DV FAQ's, does this also apply to us?

Only the primary applicant is required to meet the educational or work experience standards. So if you do not meet these requirements but your husband does, then only he should apply and of course include you as his spouse. If you have met these requirements then you are free to apply as a primary applicant by claiming chargeability to your husband's country of birth, but you MUST include him on your application and he must go to the US with you if you win..
 
I'm not sure but IMO your husband is eligible but you not as a primary but eligible through him, which makes it unsure to me if you can apply as a primary....but your husband can with you as his spouse.

He needs to have a HS diploma as a primary, you don't but if you still want to apply as a primary then you have to have at least teh HS or job requirement otherwise you will be denied.

In Germanny almost all people end up with a HS diploma so he should be fine.
 
For the people that have won on a lotter or know the process when someone wins, what do they need to see about your High School education? How do they prove this? Just with a diploma is enough, do they also require transcripts? do they contact the school to ensure that you went there?
 
High Diploma (original) and my friend brought her transcripts in but she already had sent them in when she submitted her package to do AOS.
At USCIS they looked at her College transcripts and asked her questions about it, which was kind of strange since she already had shown her Diploma but it could be due to her young age of completing High School (in school, not online or home scholing).
 
When we talk about native of a qualifying country it refers to the country in which you were born though you may be residing in a different country. If your country of birth does not appear on the list of eligible countries, you can register through your spouse's country of birth provided your spouse is from an eligible country.If one of your parents was born in an eligible country, then you can claim your parent's country of birth.To be more specific, if you were born in a country whose natives are ineligible, but neither of your parents was born there or resided there at the time of your birth, then you can claim eligibility through one of your parents country of birth, provided the natives qualify for the Lottery Program.

Here's my question does the husband qualify?

Husband country England - has HS equivalent education
Wife country Zambia - does not have HS equivalent education.

Can the husband apply as the primary applicant claiming spouse country of origin.

Or does they wife as secondary applicant MUST have HS education as a minimum for the husband do qualify??

Not having the equivalent HS qualification disqualifies you from applying for the dv lottery even though you're from an eligible country. On the other hand, your husband can apply claiming eligibility through your (spouse) country of birth (Zambia) and having the requisite educational/work experience.

What in terms of UK Qualifications is eqivalent to a US High School Diploma??

How many GCE's /CSE's are required as a minimum.

I think that varies by country, research what is the minimum in your country.
What is the minimum standard of GCE's needed to enter the work force or move on to higher education? Where I come from a full certificate (minimum standard) is 5 GCE O'Levels including Math and English Language.

So they do require you to also send transcripts? Do they contact the school too to make sure you completed your HS degree?

My wife has 3 GCE's, although she did then go on to college to study beauty therapy on a 1 year course.

I don't think 3 passes would count as equivalent to a US High School diploma

Well technically she did complete High school level as evidenced by her GCE passes. Again as I said before it all depends on what the consulate where you interview deems as equivalent. Try searching for posts where people interviewed in England (I'm assuming that you live in England) and see what the educational requirements were.
In the meanwhile you should go ahead and apply using your wife's country of birth as your country of chageability.

I'd better go and read the instructions again to see if it states you must have the equivalent of a HS diploma, I think I read somewhere that you need 5 GCSE passes at grade C to qualify???!!!


I will be applying tonight and claiming my wife's country as chargeability.:o
