Am I eligible to apply for H1

I am working for company A, but my OPT has expired and the h1 quota has reached its max. Is it possible for the company to fill me the application for next year? while I don't have my OPT
 
Employer can apply next April 1. It does not matter whether you are on OPT or living abroad. H1 is employer's petition, not beneficiaries.
