Dear all J-1 applicants,

There was lot of speculation in the recent past that, J's are not eligible/eligible for GC. My case is also J1 and I am approved recently. I never converted to H-1 and ofcourse I am still on J1. When get my GC in my hand, I am going to convert PR status. Hope this answers lot of questions from J's. So be confident, don't panic about the rumors. Law is a LAW.

Hope this Helps. If you want details-see my signature.

I second rkottani's post. I am still on J-1, never had H-1B and now have approved I-140 EB1-EA. Recently applied for I-485 and waiting.

But all J-1s make sure you waiver in hand if you want to file concurrently or just file for I-140 and J-1 waiver simultaneously. You will have J-1 waiver when your I-140 is approved.

The same here from J1 to GC without H, I used my EAD for few months to abort J status prematurely and changed jobs immediately after receiving the EAD. I changed my status from J1 to EAD with old employer for 5 days (4/25-4/30) then joined new job (5/1 - present) with the EAD then updated to GC.

My I-140 approved 3 months before the final waiver (AD I-140 1/07; AD waiver 4/07)
