what does it mean? so no more 120 days law ?
can i still sue ins in fedral court?

120 days --> 180 days

i believe you still can sue. however, it is much difficult for people to sue them.

Here is what Ron Gotcher (an attorney from immigration-information.com) said: "The House bill has very little support in the Senate and it is almost a certainty that it will not pass the Senate in anything close to its present form. Please do not think that this is now law - it isn't and I doubt that it ever will be."

I've read many comments like this one on the forums. I hope these people are right, but we still have to fight and voice our disdain regarding this bill. Be specific when you write to your Senators.

The bill passed 239 to 182, with 36 Democrats joining 203 Republicans to vote yes. Seventeen Republicans, 164 Democrats and one independent opposed the measure.

We MUST Mobilize to Oppose HR 4437, Rep. Sensenbrenner's immigration enforcement bill because it:

Could make YOU a criminal
HR 4437 will allow the government to prosecute almost any American who has regular contact with the undocumented.

Denies due process and citizenship to lawful permanent residents
HR 4437 limits judicial review of executive branch decisions (DHS) on immigration and naturalization decisions, violates the constitutional guarantee of due process and separation of powers, and, most importantly, strips the courts of their role of protecting the individual against excessive governmental power.

Divides families
HR 4437 will separate more American families with its excessive deportation authorities.

Disrupt the economy and destabilize U.S. workers
HR 4437 seeks to drive out 7 million undocumented immigrant workers, consequently disrupting the economy, with no corresponding increase in security or legality. HR 4437 will create an Employment Eligibility Verification System (EEVS) that could severely limits workers' claims, including prohibiting class action lawsuits against the government, and will displace millions of documented workers—U.S. citizens and legal residents alike.

HR 4437 is an attack on U.S. Immigration Policy, not an answer
Enforcement-only legislation like HR 4437 and the legislation that preceded it has created the largest undocumented population in our nation's history. We can't enforce our way out of the catastrophe that is our current immigration system. Our broken system demands a comprehensive, workable solution that restores the rule of law, with fair rules that are evenly enforced, not expansive enforcement that can never be implemented.

It's your turn to speak out! Call Congress Now!
Tell your Representative to VOTE NO on Final Passage of HR 4437 and to VOTE AGAINST anti-immigrant amendments during its consideration.

Call 202-224-3121 to connect to your Representative's office

I just sent emails to almost every senator requesting they object to certain provisions of HR 4437 including section 609 which takes away the right of a judicial determination for naturalization applicants.
However, I do agree that illegal immigration should be dealt with but not at the expense of law abiding legal immigrants who are already here.

quick questions for Publicus

Publicus,

First of all thank you very much for all your hard work and efforts bringing out very valuable information and making it available to us on this website. I believe if we called attorneys, we could not get half the information we receive from you on this website.

Quick questions:
Dear Publicus,

Thank you kindly for all your help. I got a few questions that need urgent answers,

1. I believe you said that you included USC 1361 (regarding an action to compel an officer of the United States to perform his duty) in your petition. However, I looked in your petition you sent, and I did not see USC 1361 in it. Did you actually put in 1361, if yes, where is it? why don't I see it? if no, do you think it is a good idea to put in 1361?

2. The copies of my petition that I send to the defendants, do they have to be copies of the stamped and filed petition at the courthouse (meaning with a stamp on it)? Or can I just print extra copies of my petition (with no stamp on it) out of my printer and mail them without getting them stamped from the courthouse. Or should I take all the copies for all defendants to the courthouse and try to get all the copies all stamped before I mail them? Can you clarify this in detail please?

3. Could you post another example of Summons besides Lamine Zeroual case.

4. Is it necessary to post a copy of N400 as exhibit attachment, everyone of those cases you looked at, did they post copy of n400 as exhibit attachment. I am thinking of not including copy of n400.

What you can do about anti-immigrant Congressmen

What you can do about anti-immigrant Congressmen

If you want to do something about the members of the House and Senate who consistently attempt to eliminate this country's legal immigration programs, I suggest the following:

* Educate yourself. Know who these people are.
* Make a point of telling your friends, family, and employer that a particular congressman in their district or their senator(s) are hostile to immigration.
* Do as much of this as possible in writing and cc the member of congress so that they know there are people out there who are trying to take votes away from them because of their immigration record.
* Donate to their election opponents and send evidence of your donation to the anti-immigrant candidate with a note explaining why you oppose them.
* If you get a response which tries to justify the congressman or senator's vote, write back and tell them that you judge them solely on their voting record.
* Get active in the community and do everything in your power to defeat these people. Become a "one issue" voter.

I'm sure that others can think of additional steps to take, but this is a start.
Also, Naturalized citizens register and vote at about twice the rate of native born citizens. Effectively, this means that a naturalized voter is worth two votes. This is one of the reasons congressmen try so hard to help with naturalization applications.

Become a force multiplier and try to persuade as many other voters as possible to oppose these people. If the last two presidential elections taught us anything, it is that every vote counts.

Bill is dead for now. Let us see what happens in the elections. It looks like democrats will gain in the house.

That means bill will be dead forever.
