H.R. 4437 would strip the courts of much of their remaining jurisdiction over immigration matters; gut the due process rights of aliens, permanent residents and United States citizens; expand expedited removal; broaden the definition of alien smuggling to include churches, employers, family members, and immigrant advocates; expand the definition of aggravated felony; create new grounds of deportability and inadmissibility; increase mandatory detention; militarize the border; and place limitations on eligibility for naturalization.

In addition, lawmakers approved a number of amendments during floor consideration of the measure, making the end product even more egregious than the initial base bill. Among these include:

# an amendment to eliminate the diversity visa lottery
# a manager's amendment that, among other things, eliminates judicial review of arbitrary denials of motions to reopen and makes misuse of passports or travel documents an aggravated felony even if committed by a refugee or a victim of domestic violence or trafficking
# an amendment giving state and local law enforcement officials the "inherent authority" to enforce civil immigration laws (the CLEAR Act revisited)
# an amendment withholding grant funds from state and local governments that maintain a policy of protecting the confidentiality of immigrants
# an amendment approving construction of more border fencing
# an amendment rendering a single DUI conviction a deportable offense
# an amendment vesting USCIS with law enforcement powers over certain investigations, and allowing the Office of Security and Investigations to engage in data-mining of DHS databases
# an amendment further increasing penalties for document fraud, crimes of violence and drug trafficking offenses

H.R. 4437 is a disappointing, disastrous measure for both immigrants and U.S. citizens alike, and AILA will be working closely with the Senate, once Congress reconvenes in January, to craft a reasoned and sensible approach to fixing our broken immigration system—an approach that offers an opportunity for success. H.R. 4437 offers no such opportunity.

In the meantime, use Contact Congress to send a letter to your Representative, either thanking him or her for voting against H.R. 4437, or expressing your disappointment for his or her vote in support of the measure. The vote tallies will be posted to Contact Congress soon.

i did not vote for John Campbell for the last electrion for the congressman because he wanted to restrict on the immigration laws.

I am very disappointed about John Campbell to vote for the HR 4437. I agree about the illegal immgiration law should be more stronger, however, this HR 4437 is hurting the legal immigratants and US citizen (naturalized)

Guys, also spread the word. Please post this on all forums that you know and frequent. Ask people to take action. We are not sit on the fence and let some fat guy make our lives hell.

i totally agree with you. However, if i send a letter to my congressman to let him know about my disappointment of his vote, since it requires the person who sends the email to fill the address and other stuff, would their info be kept in the congressman's office for whatever use in the future? (u know what i mean.... )

Don't be scared man. This is still a democracy. Free speech. You are not threatening his life. Your congressman may lose the next elections. Use your right to tell him you disagree with his vote. And ask your Senator to take a different position.

Being scared is what cause the Nazis to control Germany, and Saddam Hussein to rule for over 20 years. Take action, and let them know they were wrong.

It was always clear that the Democrats would lose. It was more interesting to see how many votes Jim Gilchrist got. He got quite a lot, but he came in third, which was less than what many observers had expected.

Not quite. There was a general anti-semite climate in Germany during that time. In fact, in the first years, people saw improvements of their lives.
And there was always considerable opposition to them. In fact, the middle class detested the Nazis, because they were quite an uneducated bunch.
But anyway, you can't compare that to the US. In fact, if they take away due process, that would most likely not survive a Supreme Court challenge.

JoeF, thank you for your answer. My Congressman opposed the bill and he is a Republican. When it comes to immigration, you cannot really separate Democrats from Republicans. But I can say the extreme views come from the Republican side unfortunately.

Please don't misunderstand my quote regarding Nazi Germany. I meant to use it an an example and in no way was it my intention to compare the US to Nazi Germany.

I hope this bill will be defeated. Taking a case to the Supreme Court will take years. I think I've waited enough.

may be you are right. i should not separate democrats from republicans when it comes to the immigraion laws. unfortunately, i checked few zip codes, those who voted for the H.R. are republicans :(

Not yet. We can still fight. Remember the Patriot Act was renewed by the House but it couldn't pass the Senate. So take action, send an email to your congressman via the link I posted in the first message, and write to your Senator. Wait for AILA instructions and help them fight this. The more people we have, the better our chances are.
 
If this passes the Senate all our lawsuits can be tossed in the trash bin. Read this section of the amended act:

(g) Effective Date- The amendments made by this section shall take effect on the date of the enactment of this Act, shall apply to any act that occurred before, on, or after such date, and shall apply to any application for naturalization or any other case or matter under the immigration laws pending on, or filed on or after, such date.

That's it. I am going to write countless letters to all senators. I need everybody to do the same please.

Senate Majority Leader Bill Frist has pledged to consider immigration reform in February. Frist said his plan is to introduce a border security bill and use that as a base to debate guest worker ideas.
 
Regrettably, my representative voted to support this cold-hearted legislation. I have sent a message to him, expressing my disappointment. :(

You just answered the question I was wondering about; whether those cases which are pending at the present time will be 'grandfathered' into the old legislation if the new law takes effect.

You're right; everyone needs to make their voice heard!
