Alert: for people whose I140 was approved for CP

It came to my attention when I saw a thread talking about CP processing. After reading that, I thought it will be a good idea to check if my I140 was approved for CP or AOS.

I talked to my lawer and inquired about my I140, the result is a big surprise to me: my employer filed my I140 for CP. From my lawer's office I learned my I140 was sent to national visa center and be requested back to VSC one month after my finger prints was cleared (late April of 2002) from FBI.

I do not know if this will further delay my I485 processing. But it is good idea to request a copy of I140 application from your lawer's office and make sure your I140 is at VSC, NOT at national visa center.
 
why it's filed for CP, do you know? It's amazing lawyers defaulty filed for CP, but why. I remember my lawyer asked me if it's for CP or AOS. I filled AOS. but that could be 485.
 
I140 application is filed my sponsoring employer. Neither lawyer nor beneficiary has any controls on what they put.

Correct me if I am wrong.
 
I think it's lawyer helped you file 140, not company. Company just provide employee leter. My lawyer filed 140 for me.
 
Well, I do not know. If my lawyer filed I140, then it was his mistake.

But I am glad that I check it out and got the answer back from national visa center that my I140 is now back to VSC.
 
I would suggest Sep/Oct long waiters check this with their lawyers. Seems very common errors by lawers. Don't wait
there, try to find out the truth of the delay.
 
sorry i am not sure about what CP stands for. does it stand for "consular process"? please let me know what it is. thanks

If it is CP ( Consular Processing ) then How are we getting EAD and APs. Are they not related only to 485s ?

I can understand the confusion. We get EAD and AP because we file I-485. You are entitled to do so.

Now, traditionally this is what happens:
When the officer is adjudicating your I-485, s/he will notice that your I-140 is approved for CP. At that time, s/he will request the original I-140 (could be from National Visa Center or the consulate abroad). Once s/he obtains the original I-140, the adjudication continues.

Now, according to wxz0205nj, it seems to me that nowadays the discovery of I-140 being approved for CP *could* even occur after the FP review is done. This should avoid the delay for adjudicating the I-485.
 
Mine was approved for CP

My I-140 was approved for CP. But I decided against going thro. CP after I-140 approval. So far I did my FP everything normally, I also got an RFE on 7/7 and responded to it.

Does this mean my I-140 file is at VSC or at NSC...

Urgent - please respond !

OK - here's my deal with I140:

1) I had filed my I140 with CP option

2) When I140 was approved my attorney ADVISED me to go 485 route since it was post 911 and told me CP will be riskly :<

3) She said she will send a letter accordingly to VSC

4) 485 filed with VSC and recd Receipt Notice

Q) How do I verify that the I140 approved for CP is with VSC ?

I will contact the attorney but with recent response from their office - I am not quite sure if they will help me.

Is this something the 800 number can help me with ?

Also I had called 800 number exactly a month back and recd the std reply that I will recv a response from VSC in a months time. Which till date I didnt...

I sure complicated my case myself ...

Answer: ask you lawyer a copy of I140 application filed by your employer. The form have a question whether you want to go for CP or AOS.

Answer: my laywe's office contacted National Visa Center. If you lawyer is not willing to help, try to find this number and call them up. You need to have you I140 case number to inquire.

If you were told (and lets say we believe it) by an IIO that your case was assigned to an officer, does that mean that your I-140 is back, safe and sound, at VSC?
