What is the necessary action to be done?
1-Do we need to have a lawyer or
2-would the Consular Post in Manila, Philippines take action according to the provision under CSPA? regarding
My daughter, a derivative benificiary who aged out when a visa number becomes available for her. She was excluded on the list for visa interview and then when she applied for a visa under CSPA she was denied because she aged-out.
Note: Her petition was approved July 2003; she turned 21 last December 28, 2003; the visa number became available for her last June 01, 2004.
She was excluded in the appointment letter dated October 2004 and was left behind last December 2004 when we were granted visa to enter US.
She applied a visa last August 2005 but was denied.
I wrote letters to Consular post inquiring the status of her case but got no replies.
Do I have also to ask assistance from US representative here in Houston Texas regarding the expiditing of the case of my daughter?
We really want to have our daughter left in the Philippines be with us.
Thank you in advance for your comments/advise.
