Age Problem Really Need Help!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Hi Guys,

 I have a serious problem regarding my age.... Actually i am 19 right now and i will be like 20 this march.... my dad just got his I-140 approved and he is gonna file for his I-485 probably in JAN and considering my age i think that it will be touch and go situation for me.....................

so do any of u guys know if a person just has to be less than 21 when they are filing a petition or is it that they have to be less than 21 by the time their 485 is approved...........

Also is there any special case under which my petition can be considered..................................

You have to be less than 21 before INS adjudicates (approves/denys) ur case

also if u r near border line ur lawyer can request INS to speed up the process and process your case out of turn(age out case)

You should definitely raise this matter with ur lawyer

I do not like to contact my lawyer on telephone -
under normal circumstances matters can wait for a day or two hence i prefer communications by email

suggest u do the same
 
I see once case has been approved within 3 months after applying 485 , becuase it is AgeOUT case

Hope lawyer should be knowing how to deal with AGEOUT cases, so not to worry about it, there is exception processing for Ageout cases, You need to mention to INS the situation very clearly.

Yes but is there a time frame when the lawyer needs to file for exception processing - like 6 months or 1 year before person becomes 21 ?

I am sure lawyer knows this option

You only have to contact him and explain that ur son\'s age is XXX
and u have a fear that he will reach XXX before adjudication
and the lawyer will explain and take care of things
 
Age Out Case

There are very specific guidelines for age out cases by INS and Texas Service Center in its web site mentions about how they need to be alerted. The first alert should be six months before the child ages out--reminders may be sent 4 and 2 months before "age out". They normally process the cases exceptionally fast when alerted as this is a part of US family reconciliation policy.

I belive the Age out case can be marked as such a year before 21st birthday or at least 6 months before turning 21! Good luck!
