Hi Guys,

EAD and : Approved.

waiting for GC. My daughter is going turn 21 years very soon( Dec). I already sent a letter to INS saying that she will turn 21, necessary action to be taken.

Please let me know is there anything which I need to do.

from the reading I did before, you/ your lawyer should specifiy that it is an age-out case when you file I-485, but this information may be too late for you now.

Well INS is a system that won't just budge for mere letters, may be your attorney can help your to expedite the process by doing some thing and will help you out.

Or even fax messages may help ?

I not sure what exactly is the procedure, just suggesting some thing...

For sure your one letter will not change anything :D
 
while applying I485 age out issues was notified to INS.
I also reminded INS by sending letter and by faxing the details.
Do I have any ways to follow up INS.

I will request my lawyer to expedite the case.
 
INS apparently have some kind of special procedures for age out cases. You lawyer should know them.

Your letters and faxes are unlikely to move INS even one millimeter. Going through AILA liason could be a nice move, but, your lawyer will have to do that .

You should also send letters to local congressman, senator...

If your lawyer applied I485 (including an age out case on pink paper) the INS does take note of that.

We were approved last month. We posted our applications in Jan2002. Our daughter will be 21 on 2Nov,2002.

We asked our lawyer to remind the INS of this issue. Ask your layer, no TELL your lawyer that he must do that. INS do not listen to us.

I requested my lawyer to expedite the case in INS.
He says he cannot beacuse my 485 is applied through company.
Lawyer is employee of that company. He also told me that INS will not respond to him.

Please let me know if this is correct, if so what should I do to expedite the case in INS.
 
Your lawyer does not seem to have read the very first chapter of "professional responsibility". I would talk to this stupid lawyer first and ask him to give me in writing that he is not representing me, I am 100% sure I will get him disbarred on this.

Time is running out for you. Go to another lawyer (you will have to pay consultation fee upfront) and tell him your story. I have heard Mr. Shusterman is good (www.shusterman.com).

In the mean time, keep sending fax to the director's office (CSC).

What a dumb unhelpfull lawyer!
In this case I WOULD hang on the telephone until I got hold of an officer.
Give them your childs WAC number and ask them if it is NOTED on their PC that it is an ageing out case and that you are concerned and that time is running out.

Officers are not all that bad, be friendly and polite and not pushing or hysterical.

Please look at the following link for new legislation regarding ageout cases. It basically says that if your son/daughter was a legal child (unmarried under 21) at the time of filing, he/she would continue to be treated as children at the time of adjudication, no matter what their age/marital status is. This is what I understood, talk to a good lawyer like all the others said

Phone/call them tomorrow!

Get your daughter to phone/call and speak with INS officer tomorrow and emphasize the fact that she's ageing out.

They will make a note of it. Do it SVR100 :)

Thanks a lot for all the information I got from here.

At last my gc got approved on 09/25.

As I was having age out problem for my daughter, I faxed a letter to INS every week. I spoke to INS officer and he told me to fax every week till I get the respond. No RFE.
