Age limit for Canada Revalidation

Hi,

Can you please let me know, if there is any age limit for going to Canada for visa revalidation.

Can a child of 10years of age, can accompany to Canada for H4 visa revalidation?

Please let me know.

** if Visa gets rejected you cant enter US from Canada you need to go directly to your home country from Canada for Visa stamping and then enter US

I have my current H1 visa valid until Dec 2005 and my company is filing for my H1 B extension, After I receive the H1-B extension Approval I am planning to goto Canada for stamping,

My daughter is in India currently, she has her H4 visa valid until Dec 2005,
(she will come here in Sep 2005)

Does she also need a H4 extension Approval Document from my company, if
she want to come to Canada for revalidation along with me?

------------------ you will get attached new I-94 with H1 extension approval notice and you can remain and work in US till validity of new I-94, you dont need Visa stamp to remain in US, what is the reason you want Visa to be stamped from Canada??

----------------------- when she enters US she will get her I-94 valid till December 2005. you need to file her H4 extension with form I-539 BEFORE her I-94 expires.( employer may not pay for H4 extensions you have to pay the fees for H4 extension of dependents)
** if your employer is going to file your H1 extension AFTER your daughter reaches US then inform the company lawyer/employer lawyer that you have dependents on H4 and would like to file H4 extension for them with your H1 extension and if the lawyer files H1 extension and H4 extension in same envelope then H1 and H4 extensions will be approved same day and your I-94 and dependents I-94 will have same expiry date

I have another question,

My company is filing for my/my daughter H1B/H4 extensions in Aug 1st week
(My daughter is coming here soon this month)

Our current visa is valid till dec 2005 in the passport.

Can I travel and come back just in case of emergency to India before Dec 2005, while my H1B extension approval is pending??

----------- what do you mean by "OUR"?? you need to post YOUR H1 visa stamp validity and I-94 validity
Post the validity of H4 holder Visa stamp or if they are in US post the validity of I-94. dont confuse others with word "OUR"

Can I travel and come back just in case of emergency to India before Dec 2005, while my H1B extension approval is pending??
-------------- if you have valid Visa stamp then you can go out and come back , but if H1 extension gets approved while you are out then let the employer send you H1 approval notice and at POE show valid Visa stamp AND H1 approval notice and you will get I-94 till H1 extension approval, check the I-94 at POE if any mistake point out to officer or ask for supervisor

Minor childs Passport renewal issue

Hi,
(I posted this in the general issues as appropriate, but also requesting you to give your expertize in this and this is very useful)

My friend has a son with her first husband whom she divorced back in India
but her sons passport bears his fathers name (her first husband)

She got married for the second time, and now while applying for her son's passport renewal in US, can she replace her current husband's name in the fathers name column?

Also there is a required document for minor childs passport
"consent of both parents in the form of a sworn affidavit"

How can she handle this here in US, can her current (second husband) can give the consent?

Please reply. your suggestions are very helpful

---------- That is related to passport and you or your friend need to speak with embassy of India or nearest Indian consulate
