Age issue for marriage.

Hello all, is there an age issue with immigration, i'm 42 and my girlfriend is 25, I would like to stay here but am afraid of getting to involved with her because of here age, anyone know how the ins looks at age differences, I'm a high income earner and she does ok.

Do you mean you are afraid to get married to her, because of the age difference? Or you are afraid of what US Immigration will think of the marriage?

If it's the first, don't get married to her. If it's the second, get married but wait until 2 years of marriage before filing for the green card (I presume with your "high income" you already have a work visa so you can stay for a while without her filing anything for you). Once you pass the 2-year mark, it is much easier to convince the authorities of the validity of the marriage, and you'll get an unconditional 10-year card when approved, instead of a 2-year conditional card that requires you to redo paperwork (and possibly re-interview) 2 years later when it expires.

I's what what the US Immigration will think of the marriage, because of the age difference, and I do not have a work visa, but came here legally and work professionally and pay my taxes, just my status has expired. thanks so much..

Then you have to expect a tough time at the interview, and you can't do anything about it except be well prepared (or go back to your home country). You can't change the age difference, and it's probably impossible to reestablish legal nonimmigrant status in your situation. So if you want to get married and stay, you just have to file the immigration paperwork and be ready to face what they throw at you.

If it is a bonafide marriage you do not have anything to worry about. You may have to supply more proof than other couples, you both may be scrutinised more, but in the end you will be approved assuming the marriage is genuine.
