Age Difference...

I have a question,

does the age difference matter when you get interviewed for AOS? My husband and I are 7 years apart and we married out of love, and plus he looks way way way younger than his age.

You are fine. Who is older by the way? According to the leaked USCIS fraud Referral Sheet and I quote verbatim "Unusual or large discrepancy between spouses (when found in conjunction with other indicators) is a fraud alert for family based petitions (I-130)

Relax. I am ten years older than my spouse yet I'm not stressing. I like her young:)

You have been married almost ten years which is a very good sign. Why did you wait this long to file? Is this your first interview?

For you, your only problem would be proving your legal entry considering you lost your I-94 etc. Once you get those from the FOIA, I assure you your interview will be a breeze. I mean come on, you have two incontrovertible pieces of evidence, the kids!

Yes will be my first interview. My husband is older.

My passport and I 94 were stolen a year after I came here and then I heard a lot of different stories from people that caused me to 'fear'.
And one attorney told me that I would never be able to get my I-94 records and that I will have to leave the country (with my 2 kids) which will be more expensive .......
So I decided I would do my own research and thank God I landed on this forum.

I am waiting for my FOIA records for I-94 and Visa to arrive so I can get started with the application (which I requested for in April).
and am going to attempt to apply for I-94 replacement using those records.
 
You are fine. Just get those records. Not even the most hardened interviewer will doubt yours is a real marriage.
 
keep in mind that those IO are human just as we are.
it's like... even if they were given no policies or training in how they should handle others age difference, they will become suspicious if the age different is huge no matter what.
this is why it's so important how you (and your spouse) present yourself.
i just got approved for my GC and my wife was 19 and i was 20 at the moment (yes the marriage was completely real!! our entire family attended the wedding in her hometown @ texas!)
anyways, when we were walking out of the interview room and through the isle where everyone else was waiting, it felt like they were all staring at us as if "they weren't in their as a married couple interview, were they??"
this is what we worried about the most before going to the interview (how IO viewed us, don't care about other people) and i'm sure he noticed and gave us an extra hard time. after all though, it turned out fine because we had all the evidences and proved that our marriage was real.

for you, kanani, i don't see much that you shold worry about personally. make sure you have all the sufficient evidence and i think the fact that you two have been married for so long looks very favorable toward you.
 
7 years difference absolutely will not raise any alarm unless one of you is under 18. If you have a problem it will be for something else.
 
You'll be fine. My wife is way older (12years) than me. We were approved. It took time though.
