Hello All
I have a question related to filing for EAD/AOS:
I am hoping to get my labor cleared in the next few months, and if i file for I-140 and I-485 and the EAD till what stage can i add someone onto my application?
I am currently single, and wanted to find out till what latest stage can i add future spouse to the application.Currently i understand that if u file for the 3rd stage one can't add a person to the application, but am not sure how it works with concurrent filing.

Please advice
Thanks a lot
Sam

----- Before your I-485 is approved.
I am currently single, and wanted to find out till what latest stage can I add future spouse to the application. Currently I understand that if u file for the 3rd stage one can't add a person to the application, but am not sure how it works with concurrent filing.
--- For GC, LC is the first stage, now with the concurrent filing of I-140 and I-485 the I-485 is what matters you. If you file your I-485 now and your spouse reaches US on H4 then you can file her I-485 with your I-485 receipt and her case will be attached to your pending file. No need to worry BCIS is not going to approve I-485 for minimum 15-18 months, all the service centers have backlog. I hope you are single and want to bring your spouse after marriage to US. If that is true then after filing I-485 and getting EAD don’t use EAD, maintain H1 status with your employer if H1 going to expire then file for H1 extension and that is the only way to get your Spouse on H4 visa and once she enters US then file her I-485. When she is coming to US get letter from any doctor from India who had MD degree that she has been given vaccination (read the Medical form what is needed). Doctor should write on his letterhead should be dated and his seal and signature that way you will save about 100$ when you file her I-485 and save on medicals.

Good Luck!!!

I am in the same boat as of sam6. Ginnu, Your information was really helpful. In essential, all you say is that all such ones can safely go ahead and apply for concurrent processing and add future spouse later on I-485 receitpt and make sure to get married before this 15 month period (which is the time frame all BCIS are currently taking to approve I-485's).

Ginnu, Pl. let me know if I interpreted wrong. Thanks again for you info.

Re: same boat...

Similar situation here. However if you plan to file concurrent, keep on the look out, I have read of posts where some people got their approval even though the processing dates had not yet reached those dates. I believe you can't get approval till you are FP'ed, so if make sure you get married before you are FP'ed (just to save you the tension). Also 15 months is not a set date, it is just the estimated time-line, so keep your eyes and ears open if you plan on concurrent filing.

-------You are correct and it not guaranteed that BCIS is going to approve I-485 in 15 months from date of filing many are waiting more than 2 years to get I-485 approved

Good Luck!!
