Hi Gurus,
Can anyone throw some light on, what the process is, to keep the GC alive after getting his GC, if the person intends to stay in India?

How long does can one stay abroad, keeping his GC still active?

How many months does he need to be in US every year?

As far as I know you have to be present in the USA atleast once in every 180 days.

It means you can come to the USA in June last week and leave July first week OR in month of Dec-Jan. It make sense to come to USA in December x'mas time and live in January. Tickets / hotel stay are cheap around that time because of winter in USA.You can do after xmas shopping as well.....right?.

My question is what should one do if spouse looses the status? When spose reapplys for GC, how long will it take to get the status back?
 
I guess in most cases, spouses are derivatives of their husbands, and in that case if the husband maintains status(by entering Dec/Jan), he can regain the status of his wife. I might be wrong in my assumption too..

I feel Dec/Jan is more appropriate as it might count towards two different years. I dont know how you came to a conclusion of June/July which would still fall under the same year.

Nothing like June/July or Dec/Jan....

365 days.... If you are staying abroad for more than 1 year and you don't have Re-entry permit, your GC will be revoked.

Now they are asking at Port of entry, 100 questions even if you are entering just before 365 days....

Unless until you have valid reason, they are telling that they don't allow you next time like this. Like this happened to one of my friends...

Hi Guys ..

To my knowledge ..

YOu cannot stay outside the US for more than 180 days in a Year.
In short you have to stay in US for 6 months in a year ( add days to months which ever way you want but at the end of the year your total number of days in US should not be less than 180 days).
If you intend to stay for more than 6 months ( say for a year) then you have to notify USCIS to prevent your GC from being revoked.
Now lets say you want to work on an assignment in India for a year , you will have to notify USCIS ..but then tricky part is you will have to get paid here in the US .( and I heard during Citizen ship they want to know why you were outside the US if you say you were on an assignment for a year they want to see the W2 for that time period).
more over the number of days that you stay here in the US on Green card also qulifies to to aplyfor citizenship.

You should physically within the US for 30 months and 5 years passed after getting GC to apply for the Citizenship. If you are out of US for more than 180 days, you will be consider that you are out of the country.

my 2 cents worth.
You cannot be out of the US without a rentry permit for more than 365 days.
However beyond a six month period you are subject to inspection and also at the discretion of the immigration officer at the port of the entry.
