Hello all,

I have a question regarding applying for adjustment of status (I-485) for your spouse after you get your citizesnhip. Keep in mind I-130 was applied few years back and is still pending.
I was wondering if anybody here has applied for adjustment of status. How long does it take for your spouse to get a GC and what kind of documents are suppose to be submitted.
Last but not least, is it a good idea to hire an attorney to do the paperwork or is it pretty straight forward ?

I believe the first thing you need to do is apply for your spouse's case to be upgraded to "immediate relative" category. Once that is done, you should be able to submit the I-485 and other required paperwork.

Thx for your quick response. I still have to wait till I get my citizenship to have her file upgraded, correct? Secondly, what kind of forms and documents are we talking about. I wish I can get the checklist of all the required/supporting documents so I can start gathering them. How long does it take for the GC and an attorney would be nice to have? Still looking for all the answers.

Yes, you need to have taken your oath before you can upgrade the petition. I'll leave it to others more knowledgeable to comment exactly how the process is undertaken, but I will say you probably don't need a lawyer.
