Affidavit of support

Hi,

Dose a self employed sponsor need to attach his business tax return to the affidavit of support or just indivitual tax return(1040) is enough?

Please advise.
 
You get the extract from the IRS, not your actual return unless it is unavailable (usually if the information from the return has not yet been achived) from the IRS.

My husband has filed these documents with affidavit of support form. He is self employed. His income is enough to support me.

Schedule A,B,D,E and 1040

We filed our joint tax on 2006.
When we filed for affidavit of support I didn't add my w2 form since I thought he is the sponsor.

Now I have received a letter from immigration that says the initial evidence for affidavit of support is incomplete.

Is this because of my w2 form ? Or we are missing something else?

eli123, I'm not familiar what a business tax return is, (is the business a separate legal entity?) but in general I would assume that USCIS is most interested in your sponsor's individual taxes.

Form I-864 includes the following instructions:

If you checked box 22(b) (self-employed), you should have completed one of the following forms with your Federal income tax return: Schedule C (Profit or Loss from Business), Schedule D (Capital Gains), Schedule E (Supplemental Income or Loss) or Schedule F (Profit or Loss from Farming).You must include each and every Form 1040 Schedule, if any, that you filed with your Federal tax return.
 
I would talk to the USCIS people. Frequently they send out forms without reading the documents closely. I was told that if you haven't got the IRS extract then the reader may or may not understand what they're looking at. A reader has about 1 minute to read a document so make it easy on him or her. I know of someone else who filed a copy of the 1040 return and not the extract and USCIS chucked it in the trash. Stupid but true! The IRS has now archived this year's tax info so contact them for an extract of personal income, it only takes 14 business days and it will save you a great deal of time and aggravation.
