Do applicants who are applying for an immigrant visa in a visa category that does not require the I-864 Affidavit of Support, such as the diversity immigrant visa, need to meet the public charge provisions of Section 213A of the INA?
No. Consular officers will review immigrant visa applicants whose visa categories do not require the I-864 under the public charge guidelines in Section 212(a)(4) of the Immigration and Nationality Act. The sponsor will need to show income at 100 percent of the federal poverty guidelines for household size, not the 125 percent required under Section 213A of the INA.

Should diversity (DV) or returning resident (SB) applicants use the I-864 or the I-134?
They should use the I-134. The I-864 can only be used in the specified categories (most family-based and certain employment-based cases). All other applicants must use the I-134 if an affidavit of support is needed.

Do the same income requirements apply to all immigrant visa applicants even if they use the I-134?
No. The 125 percent minimum income requirement, the need for the most recent year's tax return and other requirements only apply when an I-864 is needed. Applicants using the I-134 will need to show that their sponsor's income is 100 percent of federal poverty guidelines as required under Section 212(a)(4) of the INA.

Please help - DV 2006 deadline approaching

Thanks vk96 for your reply. We had our first DV interview a couple of weeks ago in Nigeria, but we were asked to provide I-134 & 1040 tax returns from our sponsor. I have read several threads but still can't find any info. on how much is a reasonable amount for your sponsor to have in their bank account for a married couple without kids. We are trying to establish whether or not my sponsor is bouyant enough to sponsor us since he is only just settling down in the US with his family having won the dv lottery himself recently.
In our I-134 form he only said he'll give us furnished accomodation and left the allowance part blank (i.e. any contributions he will make on a weekly, monthly basis / lump sum amount). My husband and I have our own savings but at the interview they said they'll only consider support evidence from the US.
Will really appreciate any help from any couple who have gone through this especially in Nigeria.
Thanks

financial support`

Hi everyone,

I am waiting for a Affidavit of Support to reach me from the US within 2/3 days by US Express Post. In case I fail to get that (my interview is supposed to be on the 10th August), can my father in law financially support me?

tell you frankly, personally i am not so much solvent according to poverty guideline.

Ferdous

Ferdous you only need affidavit of support if you're married (at least in Nigeria cause they're quite inconsistent). The sponsor has to be from the states contrary to the information given in our first letter. We initially went with my father in-law's bank details and the consular officer didn't even take it from us. I advise that you still go on that they, if they need more info. they'll ask you to bring it.

lolade, pls i will like to know the kind ofquestion you were asked as married couple, cos am also going as a married couple here in nigeria. pls can u share your experience with me.

Questions asked

Desto, they did not ask us any questions about our marriage. The man that collected our documents from us only asked us when we got married.

The consular officer then also asked the main applicant the following questions:

Why he chose to study what he studied at university?
What tools are used in his profession?
Some of the subjects studied at uni.

Other questions that I overheard / got told by other applicants - Please note this is only relevant to people whose highest level of qualification is WAEC GCE:
English: What is a noun, verb
Biology: What does DNA stand for
Geography: What are the 2 longest rivers in Nigeria
Maths: Simple calculations like: 5*6
Agric: What is a ferterlizer
Economics: What are the 2 main graphs in economics

Hope this helps.

Lolade,
The information you are requesting is found on the 2006 Poverty Guidelines posted on http://www.uscis.gov/graphics/howdoi/affsupp.htm#income
You stated that your sponsor has a family of six. Under the Poverty Guidelines, since you and your husband would be living in your sponsors household, he would have to meet 125% of the 2006 Poverty Guidelines for a household of 8 i.e sponsor, spouse,children/dependants +you and your husband.
As per the Poverty Guidelines, your sponsor would have to show that he has an annual income equal to or more than $42000.
If your sponsor cannot meet the minimum income requirements using his income, he have various options:
He may add the cash value of his assets such as money in savings accounts, stocks, bonds, and property. To determine the amount of assets required to qualify, he would subtract his household income from the minimum income requirement (125 percent of the poverty level for his household size). He must prove the cash value of his assets is worth five times this difference (the amount left over).
Example: Example for a household size of 4:
125 percent of 2006 poverty guideline $25,000
sponsor's income $19,500
Difference $5,500
Minimum Required Cash Value of Assets $27,500($5,500 Multiply by 5)

I am basing my answer on information found on the USCIS website:
http://www.uscis.gov/graphics/howdoi/affsupp.htm#income

I hope this helps. Good luck.

Thanks Steste, our application has actually been approved just waiting to pick it up now. Do we have to be in the states by the 30th Sept or 6 months after the visa is issued, even if this goes beyond 30th Sept? Thanks

Congratulations Lolade, I can only imagine how happy you must be. You don't have to be in the States by September 30th. You have 6 months from the date the visa is issued.

lolade,
thanks for your response and am happy for you, i pray God will see us through,do you know the minimum amount will be in my husband's bank statement, we already have sponsor from the states but i want to know how much will be in the account, pls if you have any idea let me know.

Desto, If you're from Nigeria I don't think they'll look at your bank statement. At least they were not interested in ours. They just really wanted one from our sponsor in the states and I have heard that $5,000, $7,000 would be sufficient ours was a bit more than that and it worked.

I guess your husband is the principal applicant??The interview day,
where you not asked a single question??? your husband did all the talking??? while you sat down relaxed huh :D ??
And em...how much did your sponsor provide in his/her financial statement for the family you mentioned before??
