affidavit of support from H1

My sister and my brother are Medical Doctors in USA , both have H1 visa, their income are very good, could they give me the affidavit support???:confused:

Affidavit of Support

Dear,

The purpose of the affidavit of support (I-134) is to ensure the U.S goverment that you will not be in a public charge while you are in the U.S.

U.S. immigration law requires that the sponsor must be either a U.S. citizen or permanent resident petitioner to prove that he/she will be able to financially support the visa applicant.

US government only requires it in a case of I-864 affidavit of support.

For I-134 (DV) there is no requirement that the sponsor be a US resident or a citizen.

It's up to the consular officer to determine whether an affidavit of support from a non-resident would have any merit.

Mr. LocyMO please note the following quoted from USIC:

Requirements for Returning resident (SB-1) and diversity visa (DV) applicants

1. A sponsor who is a U.S. citizen or LPR must provide an affidavit of support (form I-134).
2.a job letter or pay stubs.
3.a bank letter, forms 1040 and W2 for the most recent taxable year.
4. proof of U.S. citizenship or legal permanent residence.
These documents must be less than one year old when the visa is issued.

The above is intended to ensure the US government that you will not be in a public charge while in the US thus the ensurer cannot be a temporary worker or foreigner (h1 or F1 of J1...etc).

Thus the sponsor filling I-134 should be either a Citizen or LPR.

Go for it

I agree that H1 holders can submit I-134; just make sure that their bank statements, H1 papers, tax papers and employment letters are attached.
I have read of 1 case where the consular officer asked for the immigration papers of the I-134 sponsor.
If they make this an issue [just because it is a green card case]; they usually give you time to find an alternate sponsor after your interview, so long as your other paperwork is okay.
By the way, as a J-1 holder I submited an I-134 for my mum when she came on a B-2 visa and as an H-1 holder, I submited an I-134 for my brother when he came on an F-1 visa.
