Affidavit of Support for N400

Hello everyone,

I am in the process of completing the paperwork for my mother's N400.

She has been a lawful permanent resident of the United States for 19 years. She is over 75 years old and she has never worked, she has always been supported by my sister and now my husband and I. I won't wait for her to have 20 years of residence as my husband joined the military and being transferred could be an issue (we could be either in the US or overseas ). If we do happen to move, I know I would have to submit an AR-11 Change of Address form, what would happen next with her Naturalization process?

Since she never worked in the US, I would think that I would need to submit along with the N400 an Affidavit of Support. Is there a specific form I need to use and if so which form is it?

There is no such requirement. In fact, just the opposite. When a person naturalizes, the prior Affidavit of Support is voided and the sponsor is no more legally financially responsible for the sponsored immigrant beyond whatever familial (moral) obligation exists.

As for her never working, that is not uncommon, my mother never worked (outside the home) either. As she was never obligated to file taxes in the first place, she has never failed to file.

Thank you for your prompt response, very informative.

Here is my concern: so indeed, my mother never failed to file taxes since she never gained an income, thus, she never filed taxes ( same as your mother ). What if the Immigration Officer askes her for tax returns and she tells him that she never worked, is that enough then? I know she will be under Oath but just making sure...
 
If she says she never worked, the officer might ask if she's collecting a pension or who is supporting her.

If the officer is really anal, he/she might ask for proof of that pension or support, but that is unlikely.

Thank you for your response. My husband and I support her, in the rare event that the Immigration Officer aks, should I write a letter stating so? I just want to make sure I am not overlooking anything. Please accept my apologies if I seem pushy on this subject, I really appreciate your patience!

I have other questions but I will post them separately.
 
If you sponsored her green card, she could inform the officer of that fact, and that the Affidavit of Support should be in her file.

If they still continue to ask, she could show your IRS tax transcript or W2 showing that you are capable of providing such support. But again, unlikely. She could bring the tax transcript or W2 just in case, but she should not volunteer it to the interviewer.
 
JackoLantern thank you, yes I have all the tax returns so I can always bring them for her interview but like you suggested, not volunteer them.

BigJoe5 yes she does have her military ID card and a form from the military that states that she is a dependant, I guess I have been feeling so overwhelmed and I could not think straight on my own.
