affidavit of support.. Advice!!

I recently got married to my wife who is a USC, she dosent make enough money to file for affidavit of support for me, My uncle is willing to do so.. is this accceptable? or does it make it difficult..
Also, I was on F-1 but did not take classes this fall semester, because me and my wife went on a trip, is it going to be a problem, (intending to take classes again come january).. Also, do i qualify for in-state tuition? or i have to wait till my AOS goes through?
 
your uncle or anyone as a matter of fact can sponsor you as long as they are a USC or GC Holder. Just have your wife file an I-864 for herself and then have your uncle file an I-864. Make sure that he meets the 125% of poverty guidelines.
 
Provided that your uncle is a USC and meets the minimum requirements, then yes he can be used on the affidavit of support (not sure if LPRs are allowed to sponsor or not). Many people have joint sponsors and this is no problem.

Im not sure whether the issue you have with not going to classes will be a problem as this application is completely separate to an F-1. Many people have married a USC when they have been out of status following an F-1 and had a successful AOS.

As for instate tuition....that varies from state to state so look at your university's specific guidelines. For the state Im in, you need to have been a resident for a year to qualify....the status of my AOS application does not come into play. Im not sure how your current status as F-1 will affect the residency timeline though.
 
Ah- jrlaredo.....thanks for confirming that LPRs are able to sponsor...I thought they were but I didnt want to commit.
 
thanks guys.. He is a US citizen and i think meets the Minimum requirements, but Im not sure how you determine the 125% poverty line..
 
also don't forget in the poverty guideline to include yourself. So for example if your uncle has 2 kids and a wife,the household size would normally be 4 but since hes sponsoring you, then you have to include yourself so it would be 5!

Just warning you incase you missed it in the instructions!
