Affidavit of financial support - please help!!!

Hi,

I need advice on the affidavit of financial support.

The situation: My husband (U.S. citizen) filed the PR for me and my daughter last year while his 2003 income is above 125% poverty line. In 2004, although my husband's income is not above the poverty line, but our joint tax return is above 125% poverty line. In 2005, my husband's income is not going to be above the poverty line, but our combined income is above the 125% poverty line. Now, I received the notice for initial interview and WORRIED. We don't have anyone to be a co-sponsor.

Questions: (1). Because the initial filing date was more than a year ago, do we have to file a new I-864 (the Affidavit of Support) form? (1a). If we should file the I-864, do we use our combined income in 2004 or just use my husband's 2004's income? (2). Because I have a daughter (12 years old), should I file I-864A form as a co-sponsor for my daughter. (3). Should I file I-864A as the sponsored immigrant/household member to offset my husband's low income?

Please help me.

Hi you can use the combined income of you and your husband. But you have to file a a seperate i-864a to supplement the form i-864 filled by your husband.hope this helps

Hi, Thank you for reply. You mean my husband need to fill form I-864. I should fill in form I-864A to offset my husband's low income? If so, my question is do I qualified to serve as co-sponsor because I am the sponsored immigrant - I am sponsoring myself?

Thank you for your response. In 2004, my husband and I combined income was above poverty line, but below the poverty separately. In 2005, my income so far is above poverty line and my husband's is below the line.

Do you mean that my husband need to fill in a new I-864 using both of our 2004's income (which is above poverty line) or using only his 2004's income (which is below poverty line)? And I should fill in I-864A using my 2004's income or 2005's? Or, totally using separate income? Would you please explain further? Forgive my ignorance. Thank you so much.
 
Hello,
You can just use the 2004 w2 form details for you and your husband.I dont think you need to use your 2005 income as you dont have the w2's yet. Your husband needs to file 864 and specify his income and also yours as the member of household( i think in part 4) in his 864 .then you can fill out a 864a and provide the tax forms.that should be enough.hope this helps
