I don't think so. As long as the certificate is from proper authority, it is good enough. You can request your certificate anytime to authority in various reasons (for example, your original certificate is destroyed, lost or it became too fragile). And they can issue it based upon their record. In that case "issue date" will be current date and there is nothing wrong in it.
I think your attorney is too cautious. As he wants it, you can provide affidavits as backup supporting docs.
An example of affidavit (given by my attorney)

I, John Doe, solemnly state and affirm as hereunder:
1. I presently reside at XXXXXXXXXXXXXXX
2. I am a citizen of XXXXXX
3. I was borh on XXXXXXXXX at XXXXXXXX

5. I personally know that XXXX (your name) was born on MONTH, DD YYYYY

I hereby affirm the penalty of pursuant to the law of United States of America (28 USC Section 1746) that the foregoing is true and correct.
