Affidavit in place of Birth Certificate

Hello All,

I am from India and do not have a Official Birth Certificate. I have heard about being able to give a Affidavit by either parent swearing about my date of birth.

Could any of yoy help me out with what is acceptable for INS. What else is required to take care of this ?. Is there a potential for an RFE if I just send in a Affadavit ?.

I am in the same boat, I have filed my 485 only with Affidavit, but my lawyer said that I need to get a Non Avalibality Certificate from the place where I was born. So I guess if you have time then get NON Avalibility certificare atleast with affidavit. I am hoping not to get a RFE for Birth certificate as it\'s not possible for me to get NAC also. All the best to you.

Get NON-Availability certificate and affadivit from your parents - you can get the format of letter from your attorney.

Right on.
1. Non-availability certificate stating that the revenue records at the place of birth of the candidate do not contain the candidate\'s birth record.
2. Sworn affidavit by the parents (if alive) or relatives/friends who are in know of the birth of the candidate.

Birth certificates issued by the Indian Consulate may not be acceptable.

Just a reminder that you won\'t get NAC if you were born after 1969. According to the INdian consulate all births and deaths have been recorded in all hospitals since 1969

How should I start with getting a Non-Avalibility-Certificate ?. Shoud I contact the Hospital/mandal ?.
What happens if my DOB is after 1969 ?. They still might not have recorded my name during the birth registration. right ?. Is NAC absoulutely necassary. Please let me know.

You get a NAC from your municipality registrar stating
that no record of your birth on that date is made .

I could not get NAC as my birth was registered on a different
date than my official date ( you know the typical problem )

INS approved my case just with affidavit , but better to keep
NAC handy

Registrar of births and deaths issues NAC. There is no rule that persons born after 1969 should not be issued NAC; I got one for my wife who was born years later.
My lawyer told me NAC was necessary. Getting NAC should not be a problem (at least it was not a problem getting one for my wife).

My husbands case has been approved we obtained the NAC from the Taluk office near the residence at the time of his birth.The Taluk offices do register in smaller cities while muncipal offices do it in the large cities.You will get it only from such offices which was closest to your residence at the time of your birth, other offices donot entertain as we tried very hard.If you have the hospital records or your school leaving certificate and the last page of passport indicates your placeof birth you can write an application to issue a certificate. They verify the records and in 2 days they give you the same.We got a hand written note in English with a stamp of the Taluk office and the person just mentioned that he checked the records and the said persons parents did live in that area and the birth was not registered at that time.The parents name was mentioned. We were not aware of any format then and we were lucky to get some one to go to that place and do it for us.In the case of affadavits his mother and aunt gave in simple English the relationship and how long he has stayed with them and when and where he moved for his education.It was signed by a magisterate.
We were told NAC was absolutely necessary.If you have some proof like ration card or any proof to show that your parents or mother did live in the area at the time and place of your birth and a school leaving certificate to show your birth date,the offices issue NAC.Lastly note that the last page of your passport mentions the place of birth hence NAC should be from the same place.
