Guys,

I have a question regarding affidavit for birth certificate. Who should notarize it ? Is it any notary or it has to be notarized by magistrate ?

Will appreciate your input.

Thanks

We recently got our Affidavit for birth certificate made and our lawyer advised us to get it notarized by a Magistrate. May be that is a safe bet to save the future RFEs.

All the best!

We did affidavit of my parents for the BC by Indian Public Notary and got GC without any issue.

Good luck

There are two scenarios that require an affidavit :

1) Affidavit in support of a birth certificate.
The birth was registered and a birth certificate was issued, but it does not contain the name or contains only the first name. In such a situation, two separate affidavits are required in support of the birth certificate, affirming that the certificate is indeed yours. These affidavits can be issued by people who were present at the time of your birth - parents, older siblings, older relatives, neighbors, friends of the family etc.

This type of certificate does not need magistrate notarization. A public notary is sufficient.

2) Affidavit in place of a birth certificate.
The birth was never registered and the municipal body issues a "no record found" letter. In such a situation, two separate affidavits are required and they need to be notarized by a magistrate in a court of law.

Hope this helps .....

Cheers !

Can you let us know from where you got this info? Especially, if you have info from USCIS website?

AFAIK, notarized means from any notary - no requirement exists to get notarized by magistrate.
