Advise on I-485 approval

Hi all,

I applied as EB1-EA at TSC the case details given below:

I-140 RD:03/09/06; AD: 04/26/06; PD: 03/08/06

I-485 (mine) RD:09/05/06; AD: ???; LUD: 09/09, 09/22, 09/27

I-131 (mine) RD: 09/05/06; AD: 09/26/06; LUD: 09/09, 09/22, 09/26, 09/27

I-765 (mine) RD: 09/05/06; AD: 09/26/06; LUD: 09/09, 09/22, 09/26, Card received

I-485 (spouse) RD: 09/05/06; AD: ??; LUD: 09/09, 09/22, 09/27

I-765 (spouse) RD: 09/05/06, AD: 09/28/06; LUD: 09/09, 09/28, 10/02, Card mailed

I-485 (son) RD: 09/05/06; AD:??? ; LUD: 09/09, 09/27

I will appreciate if anybody can guess from the LUD if my NC is cleared or not? How can I know if my name chcek is cleared or not? Do I need to wait for a minimum number of days before I can enquire with TSC about the status of my NC. Your input will be very valuable.

No one will be able to tell you about name check based on LUDs
best you can do is
1. Try infopass
2. Try POJ trick to reach BCIS rep
3.take senator's help to get status on name check.

gret to see your updater... did you mail in your applicvatiuon directly to TSC or NSC... since they were asking to mail to NSC
 
dear eb1doc,

on your advise i called TSC and the nice lady was very helpful and she said the name check is pending (for all of my family members). my I-485 was submitted on 5th September 2006, so do you think 2nd Oct 2006 is too early for Name check clear. The TSC lady told me that its too early for name check to be cleared. Is that right?

My lawyer, sent the application to NSC, but as my I-140 was in TSC, I presume my I-485 was forwarded to TSC.

Hello Friends,
After my I-140 EB1-EA approved if I change my job (or lost my job), and apply I-485 while I will be in my new job, will it affect my I140/485. Will I get any RFE, if so can you guess what RFE possibly USCIS will send. Is there anybody has this experience. Greatly appreacie your advice on this issue. Thanks a lot.

for most of us Eb1 is current
why don't you file it asap.
when sitautaion arise that you have to leave job or loose job
then you can take up similar job (advantage with NIW & Eb1-EA)
BCIS usually don't have objection if u are in similar kinda job
generally job related RFE is not common for I-485.............

Just now I received an email from USCIS that
my EB1-EA got approved. [EB1-EA (I140-TSC), RD 8/10/06,
AD 10/04/06]. You can not believe how much I am interested to apply for I-485 now. However, my wife just visited India last month. She will be back in January 2007. I am waiting to apply once she will be here. However, I may loose my job or change my job sometimes next month. Hence, planning to apply I-485 while I will be in my new job. However, in the mean time trying to keep all the paper work ready. As you are saying, I will be fine if I do this. What is your opinion??

Congratulations!!!!. Again TSC proved to be fast in approving I-140 (EB-1EA). MY I-140 is pending at NSC for more than 106 days. Any RFE for your EB-1EA from TSC????

congrats!why can't u try going ahead with your I-485 and then later apply for her when she does her prep! there is no harm in that!!!

Thank you. I wish you will also get approved soon. I received your personal message about my credential. Here is mine: 30 publications (24 first author including 12 corresponding author ), 140 citations, 20 preprints, some book chapters, 9 reco letters (5 external, 1 national lab, 3 internal), got 5 requests for my papers, reviewed some papers, some small awards, member of one society, presided some national meetings.

I thank everybody for sharing their experience and helping at the time of critical questions. People are very cooperative in this forum. Thank you and best of luck.

Thank you so much eb1doc. I take your advice positively. I am now preparing for my I-485. Another question - if my I-485 gets approved before my wife's I-485 filing, is there any problem?? If so then what should I do. Thank you for your time and help.
