Advise - Change of Address

Hi,

I needed some advise - I am hoping for my labor approval (finally!) to come through this month. However my company is moving offices about 70 miles west of where it is now (though continuing in the state of Michigan). Unfortunately this changes the Metropolitan Statistical Area for which the labor terst is done.

I have two choices:

1. Inform Chicago Labor Office of the intention of my company to move. The risk here is that the Labor office could make me re-do my labor certification (ugh!).

2. Don't do anything - after the labor approval happens I can file my I-140 with the new address. The risk here is that INS may spot that the address indicated in the labor approval is different from that filed in the I-140 and may deny the application.

I would welcome advise from anyone who has had to face this situation.

Let your lawyer handle this situation, they know what to do in such situation, only you are not going to be effected many employer of your company who filed LC or I-140 may be in your situation and ask your lawyer what he/she is going to do in this scenario.

--- ---You should not directly inform DOL, LC is filed by employer, lawyer receives the approved copy on his address and one courtesy copy goes to Employer, if any changes to be made lawyer will handle it

--- Your address in LC (ETA 750B) can be different and on I-140 or I-485 can be different (once your Address goes on your I-485, AP, EAD and then if you change your home address you should inform BCIS and fill up the form AR11 becase I-485 AP, EAD belongs to you not to employer), no risk in I-140 filing with your different address, I-140 is not going to be denied because of address. BCIS does not punish you for changing your address. If employer changes the address, he makes the arrangements to receive the post and company has lawyer who will advise in such matters, many change office address.

Thanks for the advise. The crux of the matter is whether my lawyer should or should not inform the Chicago labor office of an intended change in address of the company (company is moving from Dearborn MI to Jackson MI) from July 28th.

I am hoping for an approval from the regional office by then and I am leaning towards telling the lawyer not to do anything till the approval come thru. After the approval comes thru, I will file my I-140 with the new company address. My only fear is the risk that someone at INS will spot that my labor approval is based on testing the labor market in the Detroit Metropolitan Statistical Area while my new company address will be in Jackson which is in the Jackson Metroplolitan Statisitical Area.
