Hi, all:
I would very much appreciate any comments or advice on the following case:
Intend to apply for EB1A in the field of business/finance:
Criterias:
* PhD and MA from an Ivy League school in Northeast
* MS from another Ivy League school in New York
* 2 publications in top international academic journals (first author)
* wrote a Forward for a book
* critical role for a leading organization (managerial role for a leading consulting firm/think-tank, was on a L1-A visa)
* annual comp in 300K+ range
* membership in professional association (membership requires 3 years of working experience + passing 3 levels of exams)
* referee for an academic journal
I would appreciate any advice on the likelihood of an EB1-A application. I've got mixed opinions from several lawyers so far.
Thank you very much.
You have to provide evidence for at least 3 of the following points
1)Documentation of the alien's receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavor;
2)Documentation of the alien's membership in associations in the field for which classification is sought, which require outstanding achievements of their members, as judged by recognized national or international experts in their disciplines or fields;
3)Published material about the alien in professional or major trade publications or other major media, relating to the alien's work in the field for which classification is sought. Such evidence shall include the title, date, and author of the material, and any necessary translation;
4)Evidence of the alien's participation, either individually or on a panel, as a judge of the work of others in the same or an allied field of specification for which classification is sought;
5)Evidence of the alien's original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field;
6)Evidence of the alien's authorship of scholarly articles in the field, in professional or major trade publications or other major media;
7)Evidence of the display of the alien's work in the field at artistic exhibitions or showcases;
8)Evidence that the alien has performed in a leading or critical role for organizations or establishments that have a distinguished reputation;
9)Evidence that the alien has commanded a high salary or other significantly high remuneration for services, in relation to others in the field; or
10)Evidence of commercial successes in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales.

1) No
2) Do you have to pay for your membership and did you apply for it or were you invited ?
3) No.
4) Did you were personally invited by the editor, do you have evidence for that with letters from him that confirm your outstanding qualification
5) Do you have excellent reference letters from independent persons comfirming that ?
6) Two papers are really not much for EA
7) No
8) Just claiming that doesn't help. Do you have independent evidence for that, for people outside your company. A L-1 visa is not evidence enough, a O1 would help at least more.
9) Look like but I don't have number to compare
10) No
That you wrote just a forward of a book doesn't help to much. If oyu would have written a chapter that would be something different.
Overall without knowing every detail I would say EA is pretty tough for you and very high risk at this point.
