Hello!

My family has got into a visa hardship and I need some help to discover possible options.

Current situation: We've arrived with my wife on L visas to US (L1 - me, L2 - wife). My job has sponsored me a green card which I received quite fast (took 1.5 years). We didn't apply for my wife's GC at the same time because we were led to believe that this is a faster and better way to go. We've filed an I-130 for her in March and has got our petition granted this week. And it's only now that we realized how long a wait for immigration visa is. My wife's visa has expired, but her I-94 (which we were told trumps visa) allows here to stay util 2014.

So, here are several questions I've got:

- Is there any possible way to speed up immigration visa?
- Is there any way to let my wife stay here with me while we're waiting for priority date? Are there any options? E.g. if we get here into university, can she apply (and realistically get) a student visa?
- Can she travel without surrending her I-94 card?
- Can we extend here L2 visa?
- Can we move somewhere to wait for here visa without losing my GC?


PS I can't believe we've got ourselves into this deep sh*t.
 
That really sucks! To answer your questions,

• Don’t see how short of you becoming a citizen miraculously
• There may be but I believe your wife is out of status since you transitioned to a green card hence she will not be able to adjust to another status here. She will have to go home. The problem is she will have difficulty getting any visa except an H-1B which allows for dual intent
• She theoretically could have gone to Canada and back without surrendering her I-94 but now since she is out of status, she cannot do that
• There is no longer any L-2 status to extend. It died when you got your green card
• Yes you can move somewhere. Make sure you apply for permission to reenter since you will be away from the US for extended periods of time

Is permission to re-enter (i-131) usually granted in such cases? Is it just two years, or will I be able to re-apply?

If you keep extending it, you stand the chance of losing your green card. Also the longer you are away from the US, the longer it will take you to qualify for citizenship due to residency requirements. It’s looking like a catch 22. Your wife may just have to stay in the shadows till you’re eligible to file for her.

Let’s see what the resident experts on the forum have to say.
 
How about form I-485? Can we benefit from the fact that mine was recently approved? Can we "retrospectively" include her in there or amend the form?
