Hi,

My husband has recently travelled to U.S on H1b a month back. This is his first job at U.S.
I have applied for H1 visa stamping (i already have the work permit) through my company in India and have got an appointment only in Aug last week. Is it advisible to apply for H4 where my H1 stamping is still in progress? If i go on H4 and later change to H1 while in U.s, can I change the H1 to H4 without travelling back to India. Will there be any issues?

Also is there any way to get the visa stamping faster? I am in desperate need to go to U.S. I am not sure to go on H1 or H4. Please give your valuable advice.

You can apply for H4 and come to US, but for that also you have to wait to get appointment. Again if you come to US with H4, the H1 whatever you are having with you has no value. You have to apply COS from H4 to H1 (almost a new H1 under quota) until then you can not start working.

Thanks for your time. Could you please tell me if I go on H1, can I convert it to H4 at a later time without having to travel back to India for stamping or do I need to come to home country for stamping the H4?

If you come to US on H1, later you can convert into H4 and stay as long as the visa valid.

Only you have to get visa stamped , if you want to go back to home country and return to USA.

If you are continue to stay in USA without shuttling to home country, you do not need to get visa stamp at all.
