Hi All,

I need advice since I will be traveling to United States for my Marriage, and I also have an Admission for PhD.
I am confused now, as to what I should apply for, my marriage is fixed in January 2014, and all the arrangements have been made.
Whether I should apply for a Student Visa or a Visit Visa??

I have already completed my Masters in US 3.5 years back, and I am living outside US since 2 years.
I have my Social, and Bank Accounts as well in US.
My spouse is a US Citizen, and we are planning to get married in January next year.

Looking forward for your Advice.

Neither. They'll probably reject both because of your US citizen fiance(e). And you can't do PhD studies in the US with a tourist visa.

Go for the K-1 visa instead. If your fiancee files the application now you might get it before January. But you probably should still request a deferment of your PhD studies because there's no guarantee of getting the visa approved in time for you to study in January.

When are you planning to start the PhD program? If it's close ,personally I would suggest you apply for the students visa so you can start your PhD, get married, and file for your green card without going the fiancee route. They don't need to know you have a fiancee who is a US Citizen. Chances they would ask whether you have a fiancee are very very slim.

If you try the fiancee route, the chances are you will not be approved in time to start your PhD.

The visa application asks about spouse/fiancee. To apply for the visa in December (while denying the existence of the fiance/e) and then arrive in the US in January to get married would risk getting in trouble for lying on the student visa application.

@Jackolantern , how much time do you think a K-1 Visa would take, if I already lived in US, and maintain Social and Bank Accounts in US??

Looking forward to hear from you.

It normally takes 3-6 months. Your previous status in the US and Social Security number won't make it any quicker.
