Please give me your advice or sample letter for responding following RFE:

"Submit a currently issued letter or other evidence from the prospective permanent employer that indicates your current position, if any, your proffered position, and proffered wage and indicating that the terms and conditions of the employment peition contiunue to exist."

My question are:
1. "permanent employer"is really confusing. Can I say that the univ. I am working in now is my permanent employer?

2. What is the difference between current position and proffered position?

3. Should I hire a lawyer to help with this RFE?

Thank you

It is not upto you to say that your university is the permanent employer. Your employer needs to issue this letter, and they do not usually have to prove that they are a permanent organization. Having said that, it is helpful for the letter to at least state that the position is indefinite, if the 'permanent' phraseology is not palatable to the HR department.

2. What is the difference between current position and proffered position?

You can be working (legally) in any position currently and assuming you are, the job you are holding now is your current position. The job that forms the basis for your immigration to the US is the profferred position (often times these two are the same but they do not have to be). Usually, it is the job for which a permanent labor certification is carried out, and in some special categories where no LC is required, it is the job based on which your I-140 is approved.

This is not a necessity. However, such an act may help the economy and achieve better distribution of wealth should you choose to give some away to a lawyer. You may not care, but it may also be tax-deductible depending on who prepares your return.

If you need further guidance on how best to write this letter to the INS, visit the "Important Information' thread in the VSC forum where there are examples (and links to examples) of several such pieces of correspondence with the INS.:)
