Also note that you can have quota-exempt H1B from the company you are planning to work for as long as you physically work at where you are working now. In other words, if you can somehow have your current research lab accomodate you physically there and your company has no problem with you physically working there for the company, you can still have quoate-exempt H1B. Thanks a lot for that info. You have lifted a huge burden off of me. I'll indeed be working 'at' an exempt employer's site even though I will be working for a non-exempt employer. I had absolutely NO idea that such a regulation existed. The HR person at this company was right when she told me that my H1B could be transferred to them. But I think she didn't know the underlying regulation because when I tried to ask her about H1 transfer between exempt/non-exempt employer and cap limitation, she had no idea what I was talking about. That put me in panic mode because I thought that when my transfer would get rejected by USCIS, I wont have time to do anything else.

Thanks to you and others who responded to my queries, especially to JerIst and moden who clearly understood what I was asking and gave some very good advice.

Thats what I was planning to do but people here are saying that once you do number 2, you can not do number 3.

Ok. What happen if somebodies H1B expire and i140 and i485 pending? Can somebody sit home (Not using EAD) for a week or month and then apply for another H1b, is it possible?
