My wife is on TD Visa and she will be filing her h1b this april.
My question is her Td visa will expire in june 2007,and because by that time her new employer has already filed H1b.
In this regard does she need to renew her Td Visa in june or can she stay back in USA until the outcome of h1b visa(October).
Kindly suggest me.
 
She needs to stay legal during the gap. This is doneby filing an I-539 of going to border with proff of your TN (which would need to be renewed before she goes).
