ok ..so here is my story..

I was granted asylum on August 2004. I have filed for my I-485 on September 2005 and I have ND 09/28/2005. I was told through infopass appointment (03/2007) that I am under FBI background check. The last time I had fingerprints was February 2006. I e-mailed TSC with regards to my case and they said that there is nothing to do because they are processing cases earlier than mine. It has been over 15 months since my finger prints have been taken and they are officially expired now. I called USCIS and their customer service initiated an inquiry on my case and said I should receive something in the mail within 45 days. Is that really true? What should I do now? My attorney suggests that I can sue. Sue for what? My case is still with in processing time according to USCIS ( it should be done by the end of September 2007). I really dont want to go through that route until I see if I can get my green card according to USCIS posting. Any suggestions? I want to contact my congresswoman about my pending name check and see maybe then things can move smoothly in order to obtain my green card. Advice????

I don't think you are still there. It is too early for you to worry your case at this time. If you recieve the magic e-mail in the near future, you are lucky; otherwise, at this stage, you will need to focus on other things that important in your life. Good luck

I hate to say that but I heard you can't even sue USCIS anymore for the delay caused by the name check. I heard about people who were stucked for 4 years and there was nothing they could do. So pretty much all you can do is just wait patiently. I know it sucks! My friend is in the same situation.
