I am on a H1B visa in US and my fiancee is in american army , gc holder and waiting for the citizenship test .He had the fingerprints done in October 2004 and they are doing the security check now.
Can I marry him now and wait till he gets the citizenship ( one month or three months) to apply for adjustment of status I-485? Or it is not a good ideea to marry him as long as he is not yet citizen?
I am just trying to save the time - from the moment of marriage I know that I have to wait 90 days to apply for adjustement of status, to prove that the marriage is in good faith.
Is anywhere mentioned that you can't marry if you applied for citizenship because you need to resubmit the file again for you and the spouse ?

What should I do?

Wait a minute…did you just said “is not a good idea to marry him as long as he is not yet citizen? “ ??
What are you really after, darling, the man or the Green Card?

If you in love and serious about him then it’s your parents you should be asking for advise whatever or not you should marry, not a bunch o strangers from the Internet forum.

If it’s a GC you have in mind, then of course – it’s in your best interests to wait until he naturalized and file your GC paperwork. It will be faster for you and less paperwork for him.

And where did you here about that 90 days rule? There is absolutely no time limit to apply for an adjustment. You can do it right after you two say your “I do” Of course it might look suspicious to immigration, or might not.
My point here is - you do not have to wait to file.
There is nothing about waiting in any instruction.
There is something about time limit for people, who come here on the fiancés visas. They have to get married whiting 90 days. But even they have no restrictions when to file.
It could be tomorrow, next month, or next year.

On the other hand, if you are just a little confused girl, who wants them both: the man and the green card, then I would say – marry him now (whenever you two ready) and if you can, wait until he gets naturalized to file for your GC. It will be faster for you and less paperwork for him. There is no time limit when to file and you better do it as soon as you ready because depending on where you live it could be up to another two years you have to wait for the interview.

And finally - there is more then just duration of your marriage for you to prove your marriage is in good faith.
Good luck to you!

thank you jane

Thank you for the answer Jane.
I am a little confused but for sure I don't want to jeopardize his naturalization. Last time when he was at the emigration office they asked him if there is any change in his status: marriage or something else. This is the reason I am asking about marrying him before becoming a citizen. He had the ideea that a change in his marital status implies refilling for naturalization and resubmitting the wife's file together with his.
Beeing myself on a H1 visa and a pending AOS , I am not so " hunting a green card" .
The issue is I don't wish to put in danger or to delay his naturalization.

Thank you,
Jane
