I have the following questions:

1. Once my AP is approved, how long can I stay out of the country? I have heard that you cannot stay for more than 60 days -- is that true?

2. I am being deputed by my company to work in India, while my I-485 is being adjudicated? Assuming that I leave when once I receive my AP, can I come back only when the I-485 is approved ?

3. Are there any issues with working in India in this fashion? Please note that my company has an office in India and I have to be there to co-ordinate the development work over there. I will be paid an Indian salary during that period.... is this ok?

Please advise.

1) No time limit..only time limit is AP expiry date.
2) I think you can..but you could face scrutiny at the POE.
3)If you get an RFE and demand for paystubs/W2/EVL doe you think your company will be able to support that request...especially on the pay-stubs ?

1. Could you please elaborate on point (2). If my company provides me with proper documents stating why I was posted to India, etc. ... it should be fine, right?

2. My company is going to provide me with pay stubs but this will be via the India Office and paid in Indian Rupees. Is this ok?

I believe that

it is not healthy to be outside the USA and get your 485 approved...there is some debate whether you become a PR after 485 approval or after ADIT processing. I specifically asked my lawyer about this and he dodged around the question saying it is better to be in the USA around the time of expected 485 approval..in my case the wait proved to be 6 months !
Anyway when you use AP to enter you are sent to secondary inspection where they will pull up your file and might ask questions about your employment status..pay stubs...payment in indian rupees would be unexpected.
If you get an RFE for paystubs and EVL, and the company sends your Indian paystubs and letter that you are employed in India...it casts a huge shadow on what the INS might think...it could mean to them that you dont need to have a job in the US or they dont have the money to pay you in the US...just raises a lot of questions more than what the rfe is intendded to raise.
Please check with your lawyer..ask him about specific examples of other cases of this nature which he has succesfully filed...get a second opinion.

Indian salary does not work. Do not have any hopes of getting GC if you get indian salary.
US salary is a must.

This is typical desi crap, do not even attemp it.

Bottomline GC is a for permanent Resisdency and you have to file taxes here in the US.


AP - can be out of the country as long as it is valid.
